Joint resolution authorizing the execution of an agreement between Lake County and the City of North Chicago providing the terms and conditions by which the City shall relocate a portion of the Robert McClory Bike Path in North Chicago in exchange for Lake County transferring ownership of a portion of the North Shore right-of-way to the City of North Chicago.

· Robert McClory Bike Path Relocation: City of North Chicago Agreement
· The City of North Chicago and Lake County mutually desire to relocate a portion of the bike path to a safer and more desirable location along a similar route in three phases.
· Phase I of the relocation provides for better security for a chemical business and a better routing of the path adjacent to it.
· Phase II and Phase III of the relocation fit in with the redevelopment plans of the City.
· To effectuate Phase I, (between Broadway Avenue and Martin Luther King Jr. Drive) a portion of county ROW needs to be transferred to the city, by Quit Claim Deed.
· This resolution authorizes the execution of an agreement with the City of North Chicago for this relocation.
· Conceptual approval for this land transfer was given by the Public Works and Transportation Committee at its March 4, 2009 meeting.

R E S O L U T I O N
WHEREAS, Lake County owns portions of the former Chicago Milwaukee and North Shore right-of-way (County Highway 75) (North Shore ROW); and
WHEREAS, Lake County owns and maintains the bike path known as the Robert McClory Bike Path on said North Shore ROW in the City of North Chicago; and
WHEREAS, Lake County and the City of North Chicago desire to have a portion of the Robert McClory Bike Path relocated as depicted in Exhibit A, A1, A2 and A3 of the draft agreement attached hereto; and
