                     US Rt. 45  By-pass of Milburn: IDOT Letter of Intent

                     The county-funded and county-lead Phase I study for this proposed by-pass was authorized by the County Board at its meeting of November 18, 2008.

                     This Phase I study is considering a by-pass of 1.5 miles.

                     FHWA is requiring the expansion of the Environmental Assessment (EA) portion of the Phase I study to consider a corridor of 5.5 miles: extending from IL Rte. 132 to IL Rte. 173 to comply with NEPA logical termini criteria.

                     The EA study is one part of a Phase I engineering study.

                     This expanded limit is to ensure compliance with Federal Project Development Procedures and therefore making the by-pass project or the eventual entire project eligible for federal funding.

                     Lake County is agreeable to expanding the EA portion of the by-pass Phase I study to these new limits with IDOT funding any additional work required.

                     Committee approval is requested to send a LOI  (draft attached) to IDOT to formulize IDOT’s funding commitment for any necessary additional work.
