Ordinance amending Lake County Board of Health Ordinance Article X for Animal/Rabies Control.
Staff Summary
· Much of the Health Department’s authority to enforce public health and safety regulations, such as those contained within the Animal Control Act and the Humane Care for Animals Act, are prescribed by Illinois Statute.
· In order to maintain consistency between the Lake County Board of Health Ordinance pertaining to Animal/Rabies Control and Illinois Statute, several amendments are required.
· Many of the proposed amendments eliminate current and future inconsistencies by adopting specific references to applicable State Statute, with the remaining proposed amendments providing clarification and simplification of current regulations.
· The Lake County Board of Health approved the proposed amendments at its meeting on February 16, 2011.

WHEREAS, the Lake County Health Department is authorized to enforce a local ordinance regulating Animal Care and Control to protect the public’s health and safety; and
WHEREAS, the ordinance that authorizes this enforcement, Lake County Board of Health Ordinance Article X (Animal/Rabies Control) requires revisions in order to be consistent and compliant with the State of Illinois public acts from which much of its authority is derived, including the Illinois Animal Control Act and the Humane Care for Animals Act; and
WHEREAS, due to revisions of several public acts, there is currently a conflict between Article X and these acts; and
WHEREAS, the proposed revisions to Article X eliminate the current, and will also prevent conflict in the future, as the revisions adopt the acts by reference; and
WHEREAS, the proposed revisions also include clarifications and corrections to the current ordinance; and
WHEREAS, the Lake County Board of Health has approved the proposed amendments to Lake County Board of Health Ordinance Article X; and
