Staff Summary
* The $113,134.11 per year will be used to support salaries, fringe benefits, operational supplies, computer equipment, contractual services, and training.
* On February 9, 1993, the County Board authorized the execution of a delegation agreement with the IEPA for a landfill inspection and enforcement program.
* There are 24 operating solid waste facilities and 22 closed landfills regulated under this agreement, with inspections and enforcement carried out by the Health Department pursuant to an intergovernmental agreement with the County.
* The current delegation agreement is set to expire on June 30, 2026.
* IEPA has provided a renewal of the delegation agreement for a five-year period, through June 30, 2031.

RESOLUTION

WHEREAS, Illinois Public Act 85-1195 states, in part, that if proceeds from a fee, tax or surcharge imposed by a local government on local landfills are to be used to conduct a local solid waste management site inspection and enforcement program, then the unit of local government must enter into a delegation agreement with the Illinois Environmental Protection Agency (IEPA) pursuant to 415 ILCS 5/4(r) (1992); and

WHEREAS, the Lake County Board passed the Lake County Solid Waste Management Tax Ordinance in April 1989, amended July 13, 2010, pursuant to PA 85-1195; and

WHEREAS, the Ordinance sets forth a priority protocol to be followed in expending the proceeds from the Tax, with one of the activities pursuant to that protocol being the funding of an inspection program for solid waste disposal facilities within Lake C...
