Ordinance establishing provisions for the licensing and inspection of swimming facilities in the County.
Staff Summary
· The Lake County Health Department currently acts as an agent for the Illinois Department of Public Health (IDPH) in the implementation of a Swimming Facilities Program.
· The Health Department inspects approximately 280 swimming facilities in Lake County on behalf of IDPH, but without reimbursement.
· Recent amendments to the Illinois Swimming Facilities Act allow local health departments to establish an ordinance and administer a Swimming Facility Program beginning January 1, 2013.
· With the adoption of the ordinance establishing a licensing and inspection program for swimming facilities, the County will now be entitled to recover costs associated with inspections and licensing.
· The proposed ordinance establishes administrative and procedural requirements for this program.

WHEREAS, the Lake County Health Department is authorized to enforce local ordinances regulating Food Service Facilities, non-community water systems, and individual sewage disposal system professionals and now swimming facilities to protect the public’s health; and
WHEREAS, Recent amendments to the Illinois Swimming Facilities Act allow local health departments to more feasibly establish an ordinance and administer a Swimming Facility Program, starting January 1, 2013.; and
WHEREAS, The proposed Swimming Facilities Ordinance establishes administrative and procedural requirements (licenses, inspections, violations, hearings, enforcement); and
WHEREAS, the Lake County Health Department has proposed amendments to Lake County Board of Health Ordinance Article XIII related to the assessment of fees for annually renewed licenses; and
WHEREAS, the Lake County Board of Health has approved the proposed Swimming Facility Ordinance; and
