Staff Summary
· The Sheriff’s Office in conjunction with the Department of Finance and Administrative Services commissioned the Sequoia Consulting Group to provide a costing study of the Sheriff’s Adult Corrections division processing bonds.
· This study, using 2008 financial data, determined the fully loaded cost associated with providing bonding services is $21.02 per bond.
· The Sheriff’s Office and the Department of Finance and Administrative Services reviewed the study and determined the appropriate charge for this service should be set at $21 per bond processed.
· The amount of revenue generated for this fee is estimated at $30,000 annually.
· The Sheriff’s Office will begin collecting this fee when the Ordinance is approved.
· Other Counties in our geographic region charge fees for this service as well, including McHenry ($28), DuPage ($30), Kane ($46) and Winnebago ($15).
Body
WHEREAS, Section 5/4-5001 of the Counties code, 55 ILCS 5/4-5001, authorizes Sheriffs in counties with fewer than 1,000,000 inhabitants to charge specified fees for services;

WHEREAS, 55 ILCS 5/4-5001 authorizes the sheriffs in counties to charge $1 for taking all bonds on legal process, civil and criminal; and

WHEREAS, 55 ILCS 5/4-5001 also that a County Board in a county with fewer than 1,000,000 inhabitants may, by Ordinance, increase the $1 bond fee and collect the increased fee from all persons and entities other than the officers, agencies, departments, and other instrumentalities of the State, if the increase is justified by an acceptable cost study sharing that the statutory fee is insufficient to cover the cost of providing the service; and

WHEREAS, the County in 2009 commissioned the Sequoia Consulting Group to provide a fee study to determine the full cost of providing bond services by the Sheriff’s Office; and
