Committee action on a variance request from Article 10 of the Unified Development Ordinance (UDO) for an extension to allow the Schall Subdivision final plat and subdivision performance guarantees to be recorded two years after the final plat approval.
Staff Summary
· The proposed subdivision is located on 4.5 acres along the east side of Chevy Chase Road, approximately ¼ mile east of Gilmer Road in Fremont Township (District 10).
· The applicant requests a variation from Article 10, Section 10.7.6.8.b of the UDO to allow a two-year extension of an approved final plat of subdivision and performance assurance to be recorded with the Lake County Recorder of Deeds.
· The applicant obtained the same variation for a one-year extension which went into effect on May 3, 2011. The aforementioned Section of the UDO provides that the Committee's approval of the Final Plat shall expire if the Final Plat and associated documents are not recorded within five days, unless other arrangements are authorized.
· Staff supports the requested variation.
