Staff Summary
· The County and the Village of Wauconda executed an Intergovernmental Agreement for construction of a sanitary sewer system within the Spencer Highlands and Elmcrest subdivisions to be owned and operated by the Village.
· The County established SSA 13 to finance the design and construction of the project.
· Per the IGA, the Village designed and constructed the sewer project and received proceeds from the SSA financing from the County.
· The County budgeted funds in FY 2008 and 2009 to reimburse the Village. However, funds were not budgeted in FY 2010 to make final payment to the Village.
· The project is now 100% complete and final reimbursement is appropriate; therefore, an emergency appropriation in the amount of $19,825.18 to Account 280-1113010-72790 and $71,774.15 to Account 278-1113010-72790 is necessary to make final reimbursement to the Village.
Body
WHEREAS, the County of Lake (County) and the Village of Wauconda (Village) executed an intergovernmental agreement (Agreement) on November 13, 2007, for the purpose of constructing a sanitary sewer collection system within the Spencer Highlands and Elmcrest subdivisions; and

WHEREAS, in accordance with the Agreement, the County established Special Service Area Number Thirteen to obtain financing to pay for the design, construction and other costs related to the Special Service Area; and

WHEREAS, the Agreement further stipulated that the Village would design and construct the sanitary sewer collection system and would receive reimbursement for the design and construction from the proceeds of the Special Service Area financing; and

WHEREAS, the County budgeted funds in Fiscal Years 2008 and 2009 to reimburse the Village for the design and construction costs; and
