Joint resolution authorizing the execution of the first amendment to the Restated and Amended Agreement for Sewage Disposal between Lake County and the Village of Lake Villa (Village).
Staff Summary
* The County and the Village entered into a Restated and Amended Agreement for Sewage Disposal, dated January 14, 2025.
* The County Board approved the Transfer of Former Lakes Region Sanitary District Assets and Responsibility Policy dated May 12, 2024, which outlined the process for transferring sanitary sewer assets and responsibilities, which the County assumed as a result of the dissolution of the former Lakes Region Sanitary District.
* The Village submitted a request to the County to transfer the ownership and operations of sanitary sewer assets within the Prairie Trails Subdivision and the Phase 1 and Phase 2 of Cedar Ridge Subdivision, all located within the Village boundaries.
* The request was reviewed and found to be in accordance with the policy by the Department of Public Works and the County Administrator's office.
* The transfer of sanitary sewer assets to the Village of Lake Villa would provide for the Village to own, maintain and manage the sanitary sewer collection system in these neighborhoods.
* The Village of Lake Villa approved the Amendment to the Agreement on October 20, 2025.
* This resolution authorizes the execution of the Amendment between the County and the Village of Lake Villa to allow for this transfer of assets and to reflect as such in the agreement service area.
* In accordance with County Board Rules, the State's Attorney's Office has reviewed this Intergovernmental Agreement prior to action by the County Board.
