Staff Summary
· Bids for the Hawthorn Woods Glennshire Water System Project were opened on August 20, 2009.
· Seven bids were submitted and the apparent low bid was submitted by Berger Excavating in the amount of $2,603,504.35. However, Berger's bid is considered non-responsive because their unit prices are imbalanced. More specifically, they submitted $0.01 unit prices on several restoration items.
· Therefore, we recommend award of this contract to Pirtano Construction Inc., of Addison, IL, the lowest responsive, responsible bidder in the amount of $2,609,710.
· The Pirtano bid is $1,745,846.65 or 40% below the engineer's estimate of $4,349,351.
· This resolution authorizes the Purchasing Agent to execute a contract with Pirtano Construction Company, Inc., in the amount of $2,609,710 for the Hawthorn Woods Glennshire Water System System Project and charging the costs thereof to Account No. 610-4836698-48310.

WHEREAS, the County of Lake (“County”) entered into a 1975 Agreement for Water Supply and Operation (“1975 Agreement”) with the Village of Hawthorn Woods (“Village”) to take over operation and ownership of a water supply system, known as the Hawthorn Woods-Glennshire water system (“HWG WS”); and
WHEREAS, the Illinois Attorney General did on November 30, 2006 file an IEPA enforcement lawsuit, entitled People ex rel. Madigan v. County of Lake, 06 CH 2569, later renamed by additional of the Village as a Defendant, People ex rel. Madigan v. County of Lake and Village of Hawthorn Woods, 06 CH 2569, against the County and Village (because the County under the terms of the 1975 Agreement operates and owns the HWG WS), which lawsuit seeks inter alia a Court order mandating the replacement of the HWG WS with a public water system built to IEPA standards; a...
