ORDINANCE
WHEREAS, on February 2, 2023, our Governor signed House Bill 3878 creating Public Act 102-1135; and
WHEREAS, this legislation requires that the Clerk/Recorder increase the base county fee from $12 to $13 per document; and
WHEREAS, the law mandates that Illinois County Clerks/and or Recorders collect this revised county recording fee beginning July 1, 2023; and
WHEREAS, the Lake County Clerk has no discretion in the matter of the mandated increase in said fees; and
WHEREAS, it is necessary for the County Board to formally adopt the mandated county recording fee increase; and
WHEREAS, the Lake County Clerk hereby requests that this Honorable Board pass this resolution during this meeting allowing the office time to inform our customers, vendors and the public, in general about this change.
NOW, THEREFORE BE IT RESOLVED, by this County Board of Lake County, Illinois, that it hereby authorizes the increased minimum recording fee to $13.
NOW, THEREFORE BE IT FURTHER RESOLVED, that the County Clerk is hereby authorized to distribute a certified copy of this Resolution to County Administration, our Chief Financial Officer, the County Auditor.
