Committee action on a variance request from Article 10 of the Unified Development Ordinance (UDO) to extend the performance period beyond the maximum three-year time limit for Lawson Woods Subdivision - District 10.
Staff Summary
· The subdivision is located on the north side of Milton Road approximately ¾ mile west of Fairfield Road in Fremont Township.
· The County has been holding a performance assurance for Lawson Woods to assure the establishment of native plantings relating to the stormwater detention basin.
· The developer has been working with staff to achieve compliance to the approved plans, however, drought conditions this past summer has not enabled plants to be established as required. A variance from the Committee will be required to extend the assurance as the performance period is beyond the 3 year maximum period.
· Staff supports the requested variation to be granted until November 13, 2013.
