Resolution to end the establishment of a Lake County Special Service Area for the installation of sanitary sewers in the Forest Haven Subdivision.

Staff Summary
· An ordinance proposing establishment of a SSA was authorized by County Board action on March 16, 2010 and set the date, time and location for the public hearing to consider establishment of the Forest Haven SSA.
· The public hearing was held on April 15, 2010 at 7:00 PM at the St. Basil Serbian Orthodox Church, 27450 N. Bradley Road, Mettawa, Illinois, 60045.
· The ordinance proposed the formation of SSA #15 however if an objection petition signed by at least fifty-one percent (51%) of the electors within the SSA territory and at least fifty-one (51%) of the owners of record of property within the SSA territory is received within the 60 days following the adjournment of the public hearing then this SSA may not be established, and shall not be proposed within the next two years.
· An objection petition was submitted to the County which needed 93 signatures of electors and 94 signatures of owners of record in order to stop the SSA establishment.
· Of the petitions received 117 electors (64%) and 118 owners of record (64%) signed the objection petitions.
· This resolution stops the establishment of the Forest Haven Special Service Area and authorizes that the Special Service Area not be reinitiated within the next two years.

WHEREAS, the County Board of Lake County (the “County Board”) is authorized to establish special service areas for the purpose of providing special services to designated areas within its boundaries pursuant to Article VII, Section 6 of the Illinois Constitution and 35 ILCS 200/27-5 et seq. (“SSA Law”), and Section 5-15010 of the Counties Code, 55 ILCS 5/1-1001 et seq.; and
