Joint resolution authorizing an intergovernmental agreement between Lake County and the Lake County Forest Preserve District concerning inclusion of parcels owned by the Forest Preserve District within Special Service Area #16.

Staff Summary
· The CLCJAWA water system extension necessary to serve Grandwood Park, Fox Lake Hills, Lake Villa and Lindenhurst is proposed to be funded through formation of a Special Service Area (SSA #16).
· The County, the Village of Lindenhurst and the Village of Lake Villa (collectively, the “Parties”) have determined that a single County SSA is the most expeditious and cost effective method of establishing the funding mechanism for project construction.
· In order to establish and maintain contiguity within the SSA it is necessary to incorporate certain Lake County Forest Preserve District parcels into the SSA.
· In order to ensure mutual terms and covenants associated with the inclusion of the District properties into the SSA, the County and the District wish to execute an intergovernmental agreement.
· This resolution authorizes execution of an intergovernmental agreement concerning the inclusion of parcels owned by the Lake County Forest Preserve District within Special Service Area #16.

R E S O L U T I O N

WHEREAS, the County of Lake (the “County”) provides potable water service to various parcels within its jurisdiction, including the Grandwood Park and Fox Lake Hills service areas; and

WHEREAS, the provision of water service is a matter essential to the public health, safety, and welfare; and

WHEREAS, in order to evaluate collective concerns regarding the adequacy of supplies for water service, the County has worked cooperatively with various other providers of water service in Lake County, including without limitation the Village of Lake Villa, and the Village of Lindenhurst (collectively, the “Parties”); and
