Staff Summary
· Proposed changes to Article X of the Lake County Board of Health Ordinance includes a new category of dog known as “animal aggressive”.
· The proposed changes will give the Animal Care and Control Program the authority to designate a dog as animal aggressive and outlines consequences of that determination.
· The proposed revisions seek to provide more protection for the public in cases where a dog seriously injures or kills another owned animal.
· Additional revisions are included to reflect the implementation of the County’s Administrative Hearing process.
Body
WHEREAS, the Lake County Health Department is authorized to enforce a local ordinance regulating Animal Care and Control to protect the public’s health and safety; and
WHEREAS, the ordinance that authorizes this enforcement, Lake County Board of Health Ordinance Article X (Animal Care and Control) also authorizes the Lake County Health Department to assess and collect fees for rabies tags and/or other services described in this ordinance; and
WHEREAS, these fees are established in Lake County Board of Health Ordinance Article XVII (Animal Care and Control Fees); and
WHEREAS, the Lake County Health Department is proposing amendments to Lake County Board of Health Ordinance Article X: and
WHEREAS, the proposed changes involve the addition of a new category of dog known as “animal aggressive” and also provides proposed revisions that coincide with the implementation of the County’s Administrative Hearing process; and
WHEREAS, the Lake County Board of Health has approved the proposed amendments to Lake County Board of Health Ordinance Article X; and
WHEREAS, the Lake County Board of Health has recommended that the proposed amendments to Lake County Board of Health Ordinance Article X be referred to the County Board for approval.
