Ordinance amending Chapter 37, County-Wide Policies and Services, to add a Subsection after 37.045 but before 37.060 in the Lake County Code of Ordinances, for the procedure for the management and disposition of Real Estate and Tax Certificates acquired by the County of Lake, as Trustee, (COLT) for the respective taxing districts through the tax sale.

Staff Summary
* The County Clerk's Office has been working with the state's Attorney's Office on updating the procedures used in managing properties the County obtains through tax deeds.
* At the February 25, 2021 meeting, staff presented information regarding the challenges with the existing procedure for the management and disposition of real estate and tax certificates acquired by the Clerk's Office. the item's background and proposed amendments to the 1987 ordinance.
* Based on direction received from Committee, an ordinance modifying the existing process has been prepared for consideration.
* In order to foster greater transparency in the process, the ordinance will be codified in the Lake County Code of Ordinances, under Chapter 37, County-wide Polices and Services, as Section 37.047 through 37.059.

ORDINANCE

WHEREAS, on July 21, 1987, the County Board adopted by resolution a procedure through which the County, as Trustee ("COLT") manages and disposes of property that the County obtains through tax sales; and

WHEREAS, the Clerk's Office, which manages the COLT process, has drafted recommended changes to the 1987 resolution that seek to more clearly articulate the discretion the Clerk's Office possesses, particularly as it relates to governmental entities and affordable housing nonprofits that seek to obtain property possessed by the County through the COLT process; and

WHEREAS, to foster greater transparency in the process, the County seeks to codify these procedure into its Code of Ordinances;
