Joint resolution approving an Intergovernmental Agreement (IGA) between Lake County and the Hispanic American Community Education Center (HACES) for the completion of an Environmental Review Record (ERR).
Staff Summary
• The HACES is the recipient of HUD Community Project Funding (CPF) for their Educational Center facility expansion project, which requires an Environmental Review Record, which is a written record that documents compliance with applicable environmental regulations for a project.
• Lake County, as a unit of general local government, is a Responsible Entity (RE) and authorized to perform the ERR for certain funding entities that do not meet the definition of a RE, such as HACES.
• The terms of the attached IGA have been reviewed by the State’s Attorney’s Office (SAO) and are consistent with previous IGAs to perform ERRs.
• The terms indicate that Lake County will be reimbursed for all expenses incurred in completing the ERR and will be used to offset the expenses incurred.

RESOLUTION
WHEREAS, The Hispanic American Community Education Center (HACES) received Community Project Funding (CPF) from the U.S. Department of Housing and Urban Development (HUD) for a Facility Expansion Project in Waukegan; and
WHEREAS, CPF requires the completion of an Environmental Review Record (ERR) by a Responsible Entity (RE) as defined in 24 CFR Part 58; and
WHEREAS, HACES does not meet the definition of a RE and has asked Lake County to serve as the RE and complete an ERR for the Project; and
WHEREAS, Lake County agrees to complete the ERR subject to the terms and conditions detailed in the attached IGA.
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the Intergovernmental Agreement with the HACES is hereby approved; and
BE IT FURTHER RESOLVED, that the County Board Chair is authorized to execute the agreement.
