Joint resolution amending Lake County Board of Health Ordinance Article XIII regarding the environmental health fees schedule.
Staff Summary
· Fee descriptions are amended to reflect and coincide with the revised onsite wastewater treatment system categories in Article V and also with the County integrated project approach.
· Some permit fees are adjusted to reflect differences in the review activities and the time involved in conducting these reviews by project type.
· In order to create an incentive to comply with the service requirements on Onsite Wastewater Treatment Systems (OWTSs) that have a mechanical treatment unit as part of the system, fees are proposed to be assessed to only those owners who are not in compliance in these service requirements(fees are currently assessed to all owners of these units). An increase in this fee is proposed, but if an owner is in compliance with the service and reporting requirements, he or she would not be assessed any fee; and
· The fees were established in order to be as revenue neutral as possible; projections indicate a potential net change in revenue of -1.2%.

WHEREAS, the Lake County Health Department is authorized to enforce a local ordinance regulating onsite wastewater treatment systems (previously referred to as individual sewage disposal systems) to protect the public’s health and safety; and
WHEREAS, the ordinance that authorizes this enforcement, Lake County Board of Health Ordinances Article V (Regulation of Individual Sewage Disposal Systems and Registration and/or Licensing of Individual Sewage Disposal System Professionals) also authorizes the Lake County Health Department to assess and collect fees for services, permits and/or licenses described in this ordinance; and
WHEREAS, these fees are established in Lake County Board of Health Ordinance Article XIII (Environmental Health Fees Schedule); and
