Resolution granting a pedestrian easement to the City of Park City along the west side of the Greenleaf Avenue right-of-way, located on the Lake County Branch Court property in Park City.
 
Staff Summary
·      On December 21, 2006 Lake County executed a Memorandum of Understanding between Park City and Lake County regarding the development of 301 S. Greenleaf Avenue by which Lake County agreed to provide an easement, ten (10) feet in width, on the subject property suitable for the construction of a sidewalk.  
·      Lake County completed the construction of the new Park City Branch Court in 2008, however the proposed easement has yet to be granted and recorded.
·      Park City is currently in the process of applying for a Lake County Division of Transportation permit to allow them to install a new sidewalk and street lighting within the proposed easement.
·      The resolution grants the pedestrian easement.

Body
WHEREAS, the Lake County agreed to provide an easement, ten (10) feet in width, on the Lake County Branch Court property in Park City; and
 
WHEREAS, Lake County completed the construction of the new Park City Branch Court in 2008, however the proposed easement has yet to be granted and recorded; and
 
WHEREAS Park City is currently in the process of applying for a Lake County Division of Transportation permit to allow them to install a new sidewalk and street lighting within the proposed easement; and
 
WHEREAS, The County of Lake is the property owner, and any action to establish the requested easement must be authorized by the County Board.
 
WHEREAS The Lake County Board has authority to grant the pedestrian easement;
 
NOW, THEREFORE BE IT RESOLVED, that the Lake County Board authorizes the Lake County Board Chairman and the Lake County Clerk to execute documents as necessary to grant the Plat of Easement to the City of Park City as defined in the attached Grant of Perpetual Right and Easement.
