Ordinance amending Chapter 173 of the Lake County Code of Ordinances - Food Service Regulations.

Staff Summary
* Amendments are proposed to Chapter 173 of the Lake County Code of Ordinances in order to conform with Illinois Department of Health (IDPH) requirements, primarily the adoption of the new Illinois Food Code, which is based on the 2017 US Food and Drug Administration (FDA) model code.
* IDPH requires all local health departments to adopt and implement the new Illinois Food Code by January 1, 2019.
* Significant proposed revisions include language that:
o Clarifies the types of food service facility permits that are issued;
o Adopts the regulation of food vending machines to make it with consistent with the new Illinois Food Code (removing many of the outdated existing requirements for food vending machines in the current Chapter 173);
o Enhances the reporting of an imminent health hazard to the health department;
o Ensures more timely correction of priority items (critical violations) to no more than 3 days; priority foundation items (violations that could lead to a critical violation) to no more than 10 days; and core items (non-critical violations) must be corrected in no later than 90 days; and
o Eliminates a scoring system, which includes "pass" or "fail" and instead includes inspection results which indicated whether there is a need for re-inspection or not.
* Most of the program's current processes will not change with the implementation of the new Illinois Food Code as the program has operated on a risk-based, educational basis since the 1990s.

WHEREAS, the Lake County Health Department is authorized to enforce a local ordinance regulating food service facilities to protect the public's health and safety; and

WHEREAS, the Lake County Board incorporated the Lake County Food Service Regulation Ordinance into the Lake County Code of Ordinances at Chapter 173 on November 12, 2013; and
