Staff Summary
• The Rental Housing Support Program (RHSP) was established, within the Illinois Housing Development Authority, to help localities address the need for decent, affordable, permanent rental housing. The Rental Housing Support Program Surcharge funds this program. All Illinois County Recorders must collect the Rental Housing Support Program Surcharge when recording executed or signed real estate-related documents and remit the surcharge to the Illinois Department of Revenue.
• On February 2, 2023, the governor signed House Bill 3878 creating Public Act 102-1135
• Public Act 102-1135 increases the RHSP Fee from $9 to $18
• The law mandates that this revised RHSP fee be collected effective July 1, 2023.

ORDINANCE
WHEREAS, on February 2, 2023, our Governor signed House Bill 3878 creating Public Act 102-1135; and
WHEREAS, this legislation requires the Recorder to collect $18 rather than the current $9 for the Rental Housing Support Program State Surcharge (commonly known as “RHSP” fee); and
WHEREAS, the law mandates that Illinois County Clerks/and or Recorders collect this revised RHSP fee beginning July 1, 2023; and
WHEREAS, the Lake County Clerk has no discretion in the matter of the mandated increase in the RHSP fee; and
WHEREAS, it is necessary for the County Board to formally adopt the mandated RHSP fee increase; and
WHEREAS, the Lake County Clerk hereby requests that this Honorable Board pass this resolution during this meeting allowing the office time to inform our customers, vendors and the public, in general about this change.
NOW, THEREFORE BE IT RESOLVED, by this County Board of Lake County, Illinois, that it hereby authorizes the increased Rental Housing Support Program State Surcharge fee amount to $18 as prescribed by law; and
NOW, THEREFORE BE IT FURTHER RESOLVED, that the County Clerk is hereby authorized to distribute a certified copy of this Resolution to County Administration, our Chief Financial Officer, the County Auditor.
