Joint resolution authorizing the execution of two Title IV-D Intergovernmental Agreements between the Illinois Department of Healthcare and Family Services and the Lake County State’s Attorney for the continuation of the State’s Attorney’s Child Support Enforcement Program between the period of July 1, 2010 and June 30, 2011, for maximum reimbursement amounts of $772,226 for staff wages and benefits and maximum of $150,000 for 66% of administrative and indirect costs.
Staff Summary
• Since 1985, the State’s Attorney has entered into an annual Intergovernmental Agreement with the Illinois Department of Healthcare and Family Services (formerly known as Illinois Department of Public Aid) to provide child support enforcement services. Pursuant to these annual agreements, the State’s Attorney’s reasonable costs of providing these services (as determined by IDHFS) are to be reimbursed.
• Since 1999, the State’s Attorney’s Child Support Enforcement staff has included 3 Assistant State’s Attorneys, 4 secretaries, 3 paralegals and 1 investigator.
• The Child Support Enforcement Division handles approximately 17,000 active cases, including those to establish paternity, to set support upon voluntary acknowledgement, to establish medical support orders, and to enforce orders for payment of support.
• IDHFS has tendered two proposed SFY 2010 contracts: one to reimburse 100% of personnel costs not to exceed $772,226 (66% of which is federal funds), and one Federal Fund Participation (FFP) contract to reimburse 66% of administrative costs and indirect costs separate from personnel costs, up to $150,000 (which is 100% federal funds).
• Expenditures submitted for reimbursement through the FFP contract must be approved by IDHFS and the federal government.
• Funding for the Lake County personnel costs contract was reduced by 3% from State Fiscal Year 2009’s contract. Funding for the FFP contract remains the same as State Fiscal Year 2009.
• The State’s Attorney recommends approval of the proposed SFY 2010 contracts.
• Sources of program funding include $772,226 from the State of IL DHFS for salary/fringe, an estimated $128,142 from the State of IL DHFS for 66% Federal Fund Participation (FFP) reimbursement of administrative and indirect costs, and estimated County contribution of $216,594 for a total of $1,116,962.
• Program budget includes wages of $653,360, fringe benefits of $269,448, non-personnel costs of $92,230 and indirect costs of approximately $101,924, for a total program budget of $1,116,962.

WHEREAS, the Illinois Department of Healthcare and Family Services (formerly known as Illinois Department of Public Aid) has notified the State’s Attorney that the Department desires to renew its Intergovernmental Agreements for the Child Support Enforcement Services; and
WHEREAS, IDHFS has tendered two proposed SFY 2010 contracts, one for salary/fringe reimbursement not to exceed $772,226 and a Federal Fund Participation (FFP) 66% administrative cost reimbursement contract in the amount not to exceed $150,000; and
WHEREAS, it is necessary for County to provide funding of approximately $216,594 without reimbursement from IDHFS; and
WHEREAS, anticipating the receipt of the final program agreement from the IDHFS for the continuation of the State’s Attorney Child Support Enforcement Program, the County Board approved a total budget of $1,130,348 for the County Fiscal Year (CFY) 2010; and
WHEREAS, the estimated program budget for State Fiscal Year 2010 (July 2010 to June 2011) is $1,116,962; and
WHEREAS, it is necessary to authorize the program agreements attached hereto.
NOW, THEREFORE, BE IT RESOLVED by this County Board of Lake County, Illinois, that the intergovernmental agreement for the State’s Attorney Child Support Enforcement Program, in the amount of $772,226 for the period of July 1, 2010 - June 30, 2011 is hereby accepted; and
BE IT FURTHER RESOLVED, that the intergovernmental agreement for Federal Fund Participation (FFP) for the State’s Attorney Child Support Enforcement Program, in the amount not to exceed $150,000 for the period of July 1, 2009 - June 30, 2010 is hereby accepted; and
BE IT FURTHER RESOLVED, that the Chairman of the Board, the Lake County State’s Attorney, and the Lake County Treasurer are hereby authorized to execute the necessary documentation in order to approve the attached agreements; and
BE IT FURTHER RESOLVED, that the appropriation in fund 101, management center 3306010 be amended to accurately reflect actual program costs between July 2010 and June 2011 and revised chart of accounts be forwarded to the Controller as soon as is practicable; and
BE IT FURTHER RESOLVED, that the State’s Attorney shall serve as project director for the program, and accurate records of all necessary grant compliance requirements shall be kept by the State’s Attorney Office; and
