RESOLUTION
WHEREAS, the Grant Township Road District desires to make certain pavement preservation improvements on a portion of the Road District’s roadway network in 2023; and
WHEREAS, the Grant Township Road District is desirous of using Rebuild Illinois Bond funds (RBI), State Motor Fuel Tax funds (MFT), and Township General funds for engineering and construction of the improvements; and
WHEREAS, the State of Illinois, acting through its Department of Transportation, distributes MFT funding to the Counties for use by the Road Districts; and
WHEREAS, the Lake County Board previously authorized the execution of an Agreement of Understanding for Maintenance and Construction (Agreement of Understanding) between the State of Illinois and Lake County, which ensures that funds administered under MFT policies and procedures are expended in a manner as prescribed by law, and rules and regulations deemed necessary by the Illinois Department of Transportation; and
WHEREAS, in accordance with the Illinois Department of Transportation, RBI funds have been deposited in the Road District’s MFT account and shall be processed in accordance with MFT policies and procedures; and
WHEREAS, in accordance with the Agreement of Understanding, Lake County is responsible for the administration, contract letting and award of Road District projects using state funds administered under MFT policies and procedures, which includes RBI funds; and
WHEREAS, the Grant Township Road District and Lake County are desirous of entering into an agreement stating the terms and conditions for each agencies role in the engineering and construction of the resurfacing improvements, a draft copy of which is attached hereto; and
WHEREAS, no Lake County funds are being used on this project.
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the County Board Chair, the County Clerk, and the County Engineer of Lake County, Illinois, are authorized, and are hereby directed to enter into an agreement, and any subsequent amendments, between Lake County and the Grant Township Road District for the above referenced resurfacing project; and
BE IT FURTHER RESOLVED, that the County Engineer shall transmit, in writing, the final agreement and any amendments, to be executed by the County Board Chair and the County Clerk.
