Joint resolution authorizing the execution of an Intergovernmental Agreement between the Village of Grayslake and the County of Lake regarding the Cornerstone Development (Alter Property).
Staff Summary
·      Lake County Land Holdings, LLC, is proposing to develop the Alter Property, which is approximately 641 acres near Peterson Road, Route 83 and Alleghany Roads.
·      The property will be developed in the Village of Grayslake as a Planned Unit Development, consisting of residential, retail/commercial, light industrial, and office uses.
·      The Village is requesting sanitary sewer service for the development, with certain limitations, which will require the "Third Amendment to the Restated and Amended Agreement for Sewage Disposal," which will be considered under a separate resolution.
·      The proposed development will necessitate certain roadway and traffic improvements, that will be documented in the "Central Lake County Area Transportation Improvement Intergovernmental Agreement," and will be considered under a separate resolution.
·      The development of the Beelow Parcel will satisfy the standards for development of the Central Range Area of the Heartland Property as set forth in the Heartland Settlement Agreement.
·      The County shall perform building code compliance, permitting and inspections for any development upon the Beelow Property, which will be documented in the Intergovernmental Agreement for Building and Zoning Code Enforcement Contract Services.
·      The developer is required to execute School Impact agreements prior to execution of this Agreement.
·      The developer is also required to develop the property in phases so that the residential development is balanced with the non-residential development.
Body
WHEREAS, the County of Lake (County) and the Village of Grayslake (Village) have previously entered into an Amended and Restated Agreement for Sewage Disposal, which has been amended from time-to-time; and
WHEREAS, the Cornerstone Property, which is owned by Lake County Land Holdings, LLC has been annexed to the Village pursuant to an annexation agreement to permit a Planned Unit Development in accordance with a Master Plan; and                                
WHEREAS, the Village desires to extend Sewer Service to the Cornerstone Property; and
WHEREAS, the County and the Village recognize that the Proposed Development will cause the need for certain roadway and traffic improvements; and
 
WHEREAS, the Village, the County, and the then-property owner of a tract of land known as the "Heartland Property" entered into a Settlement Agreement and Release dated October 16, 1986 (the "Heartland Settlement Agreement"), which Heartland Settlement Agreement established, inter alia, development standards for various portions of the Heartland Property.  Because a portion of the Cornerstone Property (the "Beelow Parcel") is located within the Heartland Property, the Village and the County also desire to clarify how matters relating to the Heartland Settlement Agreement will be addressed vis-à-vis the Beelow Parcel; and
WHEREAS, to that end, the County and Village agree that the County shall perform all building code compliance, permitting, and inspections for any development occurring wholly or predominantly on the Beelow Parcel; and
WHEREAS, an Intergovernmental Agreement has been prepared that sets forth the rights, responsibilities and obligations of each party; and
      WHEREAS, execution of an Intergovernmental Agreement must be authorized by Resolution of the County Board; and
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the Chair of the County Board and the Clerk of said County be and they are hereby authorized and directed to execute the attached Intergovernmental Agreement, in the form substantially contained therein, with the Village of Grayslake regarding the Cornerstone Property.
BE IT FURTHER RESOLVED, by this County Board of Lake County, Illinois, that the Chair of the County Board and the Clerk of said County be and they are hereby authorized and directed to:
Execute, at such time that the County Board Chair and County Administrator shall determine is appropriate prior to the acceptance of any building permits or other development permit applications for the Beelow Parcel and without further County Board action required, an Intergovernmental Agreement for Building and Zoning Enforcement Services between the Village of Grayslake and the County of Lake Regarding the Beelow Parcel, in substantially the form attached to the Intergovernmental Agreement as Exhibit G, subject to any revisions authorized by the County Administrator, the Lake County Board Chairman and the Lake County State's Attorney.
