RESOLUTION
WHEREAS, on April 21, 2025, a public hearing was held before the Board of Vacations pursuant to Section 151.204 of the Lake County, Illinois Code of Ordinances, as amended, on the petition of Gordon and Nannette Kiesgen, Anthony Wilson & Deborah C. Fredericks, and Thomas Filler, record owners of 38054 & 38078 N Dewey Street, 38081 N Lee Avenue, and 38119 N Lee Avenue, respectively, requesting a vacation of an unimproved right-of-way located between N Lee Avenue and N Dewey Street, approximately 50 feet wide, that extends approximately 250 feet southeast, and consists of approximately 0.29 acres, located in the Fox Lake Vista Number One Subdivision, Spring Grove, Illinois, and more fully described as follows:
The right-of-way sought to be vacated is all that part of the unnamed - unimproved road lying between North Lee Avenue (a.k.a. Watts Avenue) and North Dewey Street, also lying and between blocks 24 and 25 in Fox Lake Vista Unit Number One, described as follows: Commencing from the southeast corner of lot 11 in block 25 in Fox Lake Vista Unit Number One, being a subdivision of the southwest quarter of Section 33 all in Township 46 north, Range 9 east of the third principal meridian, according to the plat thereof recorded January 11, 1928 in book "S" of plats, pages 47, 48 and 49, as document number 311410, in Lake County, Illinois; thence north 33 degrees 46 minutes 14 seconds east on the northwesterly right of way line of North Dewey Street for a distance of 400.50 feet (400.60 feet measured) to the northeasterly corner of lot 18 in block 25 in Fox Lake Vista Unit One, for the point of beginning; thence north 33 degrees 46 minutes 14 seconds east on the northwesterly right of way line of North Dewey Street for a distance of 50.00 feet; thence north 56 degrees 16 minutes 03 seconds east on the southerly line of lots 11 and 10 in block 24 of Fox Lake Vista Unit Number One for a distance of 250.00 feet (249.87 feet measured) to the southwesterly corner of lot 10 block 24 in Fox Lake Vista Unit One; thence south 33 degrees 46 minutes 30 seconds west on the southeasterly right of way line of North Lee Street (a.k.a. Watts Avenue) for a distance of 50.00 feet to the northwesterly corner of lot 1 block 25 in said Fox Lake Vista Unit One; thence south 56 degrees 16 minutes 04 seconds east on the northerly line of lots 1 and 18 in block 25 in Fox Lake Vista unit one for a distance of 250.00 feet (249.87 feet measured) to the point of beginning all in Lake County, Illinois; and
WHEREAS, the petitioners are the owners of the following parcels of real estate, to-wit:
Lot 11 in Block 24 in Fox Lake Vista, Unit One (1) being a subdivision of the southwest quarter of section 33, all in Township 46 north, Range 9, east of the third principal meridian, according to the plat thereof, recorded January 11, 1928 in book “S” of plats, pages 47, 48 and 49, as document 311410, in Lake County, Illinois; and
Lot 18 in Block 25 in Fox Lake Vista, Unit No. 1 being a subdivision of the southwest quarter of section 33, all in Township 46 north, Range 9, east of the third principal meridian, according to the plat thereof, recorded January 11, 1928, as document 311410, in book “S” of plats, pages 47, 48 and 49, , in Lake County, Illinois; and
Lot One (1) in Block twenty-five (25) in Fox Lake Vista Unit Number One (1) being a subdivision of the southwest quarter (SW1/4) of section thirty-three (33) and part of the southeast quarter (SE1/4) of section thirty-three (33), all in Township forty-six (46) north, Range nine (9), east of the third principal meridian, according to the plat thereof recorded January 11, 1928 in book “S” of plats, pages 47, 48 and 49 as document 311410, in Lake County, Illinois; and
Lot 10 in Block 24 in Fox Lake Vista Unit No.1, being a subdivision of the southwest 1/4 of section 33 and a part of the southeast ¼ of section 33, all in Township 46, north, Range 9, east of the third principal meridian, according to the plat thereof, recorded January 11, 1928 as document 311410, in book “S” of plats, pages 47, 48 and 49, in Lake County, Illinois; and
WHEREAS, after reviewing the testimony presented at the aforementioned public hearing of the Board of Vacations, said Board has submitted its recommendation and report to the Planning, Building, Zoning and Environment Committee; and
WHEREAS, the Board of Vacations recommends approval of the vacation request based on the finding that: the vacation request meets the standards of a vacation request because it is not currently being used by the public and will have no negative impact on the residents of the area.
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the public right-of-way, as described above, is hereby vacated and that portion of said plats of subdivision are hereby revoked, annulled, and set aside; and
BE IT FURTHER RESOLVED, that this resolution shall take effect and be in force for and after its passage provided that said petitioners shall after the passage of this resolution, file for recording in the office of the Recording Division of the Lake County Clerk’s Office, a certified copy of this resolution, the application, and the Deed of Vacation.
