Staff Summary

                     2010 Patrol One Materials: Emergency Paint Supplemental Appropriation and Line Item Transfer

                     Lake County purchases pavement marking paint through the joint Purchasing Contract with the State of Illinois.

                     Raw material resins used in the manufacture of the paint are in short supply resulting in Lake County not receiving its requirement for the 2010 pavement marking program.

                     The County Engineer certified an emergency procurement and the Purchasing Agent issued a purchase order for 12,045 gallons of white paint and 9,020 gallons of yellow paint.

                     The selected vendor is Hallman Lindsay Quality Paints, Sun Prairie, Wisconsin, at a price of $8.63/gallon for white paint and $8.73/gallon for yellow paint.

                     This resolution, per the Lake County Purchasing Ordinance Sec. 6-103, ratifies the emergency procurement.

                     This resolution also rescinds the contract with Ennis Paint, Ennis, Texas due to their inability to fulfill their contract

                     The total purchase amount for Hallman Lindsay is $187,114.16.  This is $17,114.16 over the 2010 appropriation for Patrol One paint materials

                     The net additional cost will come out of the Motor Fuel Tax construction fund budget by a line item transfer to Patrol One

                     A supplemental appropriation of $20,000 is made from the Motor Fuel Tax Fund and designated as Section 10-00000-00-GM

R E S O L U T I O N

WHEREAS,  each fiscal year the county estimates its pavement marking paint quantity needs and participates in joint purchasing with Central Management Services (State of Illinois); and

 

WHEREAS, on April 23, 2010, Lake County was in receipt of a memorandum from Ennis Traffic Safety Solutions, Dallas, Texas, the State of Illinois pavement marking paint awardee, explaining that resins used in the manufacture of water-borne paint are in short-supply world-wide; and

 

WHEREAS, the consequence of this being that Lake County cannot expect to receive scheduled shipments of paint until July-August, 2010 and in uncertain quantities; and

 

WHEREAS, there was a need to secure a sufficient quantity of paint in order to meet the 2010 season pavement marking program; and

 

WHEREAS, staff identified a firm whom can manufacture the required paint; and

 

WHEREAS, in accordance with Article 6-103 of the Lake County Purchasing Ordinance, the County Engineer of Lake County declared that an emergency existed and in order to address said emergency the Purchasing Agent issued a purchase order to Hallman Lindsay Quality Paints, Sun Prairie, Wisconsin for 12,045 gallons of white paint at the unit price of $8.62/gallon and 9,020 gallons of yellow paint at the unit price of $8.73/gallon plus $4,500 for shipping; and

 

WHEREAS, the estimated cost of said pavement markings materials for the 2010 pavement marking season is  now estimated to be $187,114.16; and

 

WHEREAS, a supplemental appropriation is required to acquire these materials.

 

NOW, THEREFORE BE IT RESOLVED, by this County Board of Lake County, Illinois, that Emergency Procurement authorized by the County Engineer with Hallman Lindsay Quality Paints, Sun Prairie, Wisconsin in the amount of $187,114.16 for pavement marking paint charged to account # 268-4300040-65030 is ratified.

 

BE IT FURTHER RESOLVED, by this County Board of Lake County, Illinois, that said contract with Ennis Paint, Ennis, Texas is rescinded.

 

BE IT FURTHER RESOLVED, by this County Board of Lake County, Illinois, that there is hereby provided a supplemental appropriation of $20,000 of Motor Fuel Tax funds for the acquisition for the above-said pavement marking material for the 2010 season and designated as Section 10-00000-00-GM. 

 

BE IT FURTHER RESOLVED that budget expenditure line item 268-4300040-65030 be increased by $20,000. 

 

BE IT FURTHER RESOLVED that budget expenditure line item 268-4300030-85020 be decreased by $20,000. 

 

BE IT FURTHER RESOLVED that this appropriation be processed by the County Engineer for final approval of the Illinois Department of Transportation in accordance with the “Agreement of Understanding” between the Illinois Department of Transportation and Lake County, dated January 22, 2003.
