Ordinance adopting a revised fee schedule for the Lake County Sheriff’s Office.
Staff Summary
• The Sheriff’s Office, in conjunction with the Finance Department, completed a fee study analysis on the cost of certain services the Sheriff’s Office provides.
• The services include:
o Service of summons, paper copies and subpoenas throughout Lake County, on average, fees will decrease 26.79 percent.
o Replevin (return of property pursuant to court order), on average, fees will increase 113.33 percent.
o Evictions (removal of individuals pursuant to court order), on average, fees will decrease 8.54 percent.
o Eviction enforcement past the initial hour will be billed at $110 per hour/per deputy, a decrease of 11.29 percent.
o Fingerprint Fee an increase of 8.7 percent.
• The Sheriff’s Office and the Finance Department reviewed these fees in 2021; however, none of these fees have been modified since 2017.
• The recent analysis illustrated that the fee charged for each of these services were utilizing an outdated formula.
• As a result of the study, a revised fee schedule should be adopted, with an effective date of December 1, 2025.

ORDINANCE
WHEREAS, Illinois law authorizes the Sheriff to charge fees for specified services conducted by said office; and
WHEREAS, the Illinois General Assembly passed and the Governor signed into law 55 ILCS 5/4-5001; and
WHEREAS, 55 ILCS 5/4-5001 provides that the County may modify the fees charged by the Sheriff if the County can demonstrate that said statutory fees are inadequate; and
WHEREAS, the Sheriff’s Office and the Finance Department reviewed these fees in 2021; however, none of these fees have been modified since 2017; and
WHEREAS, the Sheriff’s Office in conjunction with the Finance Department completed a fee study analysis using 2026 financial data of the full cost of providing these services; and
WHEREAS, the results of said fee analysis combined with additional review showed fees being charged by the Sheriff should be modified; and
WHEREAS, it is in the best interest of the citizens of Lake County that the cost of performing a specific service should be primarily born by the user of that service and that, therefore, the fee should reflect the actual cost for that service; and
WHEREAS, it is necessary for the County Board to formally amend Ordinance 35.36 Fees for Services Performed by Lake County Sheriff’s Office to read:

NOW, THEREFORE, BE IT ORDAINED, by this County Board of Lake County, Illinois, as follows:
1. The Lake County Sheriff shall charge the fees as established by the County Board herein shown in Tables A, B, C, along with $110 for eviction service rescheduling and $25 per fingerprint card requested effective December 1, 2025.
BE IT FURTHER ORDAINED, that the County Clerk is hereby directed to forward a certified copy of this Ordinance to the Lake County Sheriff.
