Staff Summary
• The CLCJAWA water system extension necessary to serve Grandwood Park, Fox Lake Hills, Lake Villa and Lindenhurst is proposed to be funded through formation of a Special Service Area (SSA #16).
• The County, the Village of Lindenhurst and the Village of Lake Villa (collectively, the “Parties”) have determined that a single County SSA is the most expeditious and cost effective method of establishing the funding mechanism for project construction.
• The Parties have agreed to jointly share in funding the work to obtain legal, management, surveying and financial services necessary to propose and establish the SSA.
• In order to ensure the rights and responsibilities of the Parties collectively and individually as related to the SSA services, the Parties have established and wish to individually approve and authorize execution of a memorandum of understanding.
• This resolution authorizes execution of Memorandum of Understanding.

R E S O L U T I O N
WHEREAS, the County of Lake (the “County”) provides potable water service to various parcels within its jurisdiction, including the Grandwood Park and Fox Lake Hills service areas; and
WHEREAS, the provision of water service is a matter essential to the public health, safety, and welfare; and
WHEREAS, in order to evaluate collective concerns regarding the adequacy of supplies for water service, the County has worked cooperatively with various other providers of water service in Lake County, including without limitation the Village of Lake Villa, and the Village of Lindenhurst (collectively, the “Parties”); and
WHEREAS, the Parties have been working with the Central Lake County Joint Action Water Agency (“CLCJAWA”) on the potential of obtaining Lake Michigan water; and
WHEREAS, the CLCJAWA has determined that their system has available capacity to serve the Parties; and
WHEREAS, in order for the Parties to connect to the CLCJAWA water system, certain water main extensions and improvements must be designed and constructed (the “Project”); and
WHEREAS, it is deemed advisable and necessary for the Parties to fund the Project by participating in and establishing a Special Service Area (SSA); and
WHEREAS, pursuant to Special Service Area Tax Law of the State of Illinois (35 ILCS 200/27), as amended, the County is authorized, after certain proceedings, to borrow money and issue bonds secured by the full faith and credit of special service areas; and
WHEREAS, the County proposes to obtain legal, management, surveying and public finance services necessary to propose and establish the SSA (SSA Services); and
WHEREAS, the Parties have agreed to contribute a proportionate share of the monies needed to fund the SSA Services; and
WHEREAS, in order to ensure the rights and responsibilities of the Parties collectively and individually, as related to the SSA Services, the Parties have established and wish to individually approve and authorize execution of a Memorandum of Understanding;
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois that the County Clerk and County Board Chairperson be hereby authorized to execute the Northern Lake County Water Special Service Area Planning Group Memorandum of Understanding, generally in the form attached.
