R E S O L U T I O N
WHEREAS, the Lake County Public Works and Transportation Committee endorsed an Excess Property Disposal Policy at its regular meeting on March 8, 2017; and
WHEREAS, excess parcels of County owned property designated as Index #17 PIN 11-15-302-004 & 11-15-302-007 have been identified as a priority to dispose of by quitclaim deed under the transfer of excess property to the government agencies section of said policy; and
WHEREAS, the excess property containing a total of approximately 1.612 acres, zoned residential, lies in the Des Plaines River channel and is adjacent to and adjoining property owned by the Lake County Forest Preserve District; and
WHEREAS, by disposing of the excess parcels, which were acquired in 1966 and are not needed for current or future transportation improvements by the Lake County Division of Transportation, the property will be more appropriately utilized for the public under the stewardship of the Lake County Forest Preserve District; and
WHEREAS, the Lake County Forest Preserve District has agreed to accept the transfer of the property and will adopt an acceptance ordinance for its June 2017 meeting; and
WHEREAS, the County Engineer and the Public Works and Transportation Committee recommend the transfer of the excess parcels to the Lake County Forest Preserve District; and
WHEREAS, the County will prepare a quitclaim deed to be signed by the County Board Chairman and attested by the County Clerk which will transfer the ownership to the Lake County Forest Preserve District at no cost; and
WHEREAS, in compliance with the Local Government Property Transfer Act (50 ILCS 605/2) the County adopts this resolution approved by a 2/3 majority of the County Board at its regular meeting on June 13, 2017, and this resolution will be effective upon adoption by the Lake County Forest Preserve District of the ordinance referenced above.
NOW THEREFORE BE IT RESOLVED, that the property transfer is approved, and the County Board Chairman is hereby authorized to execute the quitclaim deed and the County Engineer is hereby directed to record and cause to be recorded in the office of the Recorder of Deeds the quitclaim deed conveying said excess property to the Lake County Forest Preserve District and to take any and all other actions necessary to complete such conveyance.
