· The intersection improvement of Rollins Road, at Illinois Route 83, will be improved, along with construction of a grade separation of the Canadian National Railroad (CN RR), to provide increased traffic capacities (Rollins Road Gateway Improvement).
· NICOR has a gas main along Illinois Route 83 located within an easement that must be relocated to accommodate the upcoming highway improvement.
· The relocation of the gas main is proposed to be done before the construction of the highway improvement.
· It will be necessary for the County to reimburse NICOR for the cost of relocation, estimated to be $1,400,000.
· This resolution authorizes the execution of an agreement with NICOR that provides for the relocation of their gas main, and appropriates $1,850,000 of ¼% Sales Tax for Transportation and Public Safety funds.

R E S O L U T I O N
WHEREAS, Rollins Road, County Highway 31, is a designated route on the County highway system; and
WHEREAS, it would be beneficial for the safety and welfare of the motoring public if Rollins Road, at its intersection with Hainesville Road, County Highway 24, and Illinois Route 83, could be improved along with construction of a grade separation of the CN RR to provide increased traffic capacities (Rollins Road Gateway Improvement); and
WHEREAS, NICOR has a gas main along Illinois Route 83 located within an existing easement in the area of the improvement; and
WHEREAS it will be necessary to relocate the said gas main to accommodate the upcoming improvement of Rollins Road, at its intersection with Hainesville Road and Illinois 83; and
WHEREAS it will be necessary for Lake County to reimburse NICOR for the cost to relocate their gas main, estimated to cost $1,400,000; and
WHEREAS, NICOR and Lake County are desirous of entering into an agreement to provide for the relocation of the said natural gas line setting forth the terms and obligations to each agency, a draft copy of which is attached hereto; and
WHEREAS, in order to start the relocation work, an appropriation of funds is needed.
NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that the County Board Chair, the County Clerk and the County Engineer of Lake County are authorized and they are directed to execute an agreement, and subsequent amendments, pertaining to the terms and conditions of the above-named utility relocation.
BE IT FURTHER RESOLVED that the County Engineer shall transmit, in writing, the final agreement, and any amendments, to be executed by the County Board Chair and the County Clerk.
BE IT FURTHER RESOLVED that there is appropriated $1,850,000 of ¼ % Sales Tax for Transportation and Public Safety funds for this utility relocation, and is designated as Section 08-00080-56-BR.
