Joint resolution authorizing the execution of an amendment to Agreement #2 with Commonwealth Edison (ComEd) for the relocation of distribution facilities located within the ComEd right-of-way and the Canadian National Railroad (CNRR) right-of-way for the Rollins Road at Illinois Route 83/CNRR intersection/grade separation improvement, appropriating a supplemental $1,500,000 of ¼% Sales Tax for Transportation and Public Safety funds, and designated as Section 08-00080-56-BR.

· At the July 10, 2012, County Board meeting, Agreement #1 with ComEd was approved for relocating transmission facilities and $3,625,000 of ¼% Sales Tax for Transportation and Public Safety funds was appropriated based on an estimated cost of $3,080,732.
· At the March 12, 2013, County Board meeting, a supplemental appropriation for Agreement #1 for $1,000,000 of ¼% Sales Tax for Transportation and Public Safety funds was approved for the relocation of the transmission facilities.
· At the November 20, 2012, County Board meeting, Agreement # 2 with ComEd was approved for the relocation of distribution facilities and $1,800,000 of ¼% Sales Tax for Transportation and Public Safety funds was appropriated.
· ComEd has completed updated design work to include the installation of a new 36" casing running 340' west under Illinois Route 83 and the CNRR, as well as the installation of 920' of 12" duct, 350' of 6" duct and 900' of 2" duct, relocation of 16 poles, and associated wiring and equipment with the new estimated cost for the relocation of the distribution facilities being $2,995,000.
· This resolution authorizes the execution of an amendment to Agreement #2 with ComEd that provides for the relocation of their distribution facilities, and appropriates a supplemental $1,500,000 of ¼% Sales Tax for Transportation and Public Safety funds for these utility relocations.

R E S O L U T I O N
WHEREAS, Rollins Road, County Highway 31, is a designated route on the County highway system; and
WHEREAS, it would be beneficial for the safety and welfare of the motoring public if Rollins Road, at its intersection with Hainesville Road, County Highway 24, and Illinois Route 83, could be improved along with construction of a grade separation of the CNRR to provide increased traffic capacities (Rollins Road Gateway Improvement); and
WHEREAS, this County Board, at its meetings of July 10, 2012, and March 12, 2013, approved a separate agreement with ComEd for the relocation of transmission facilities located within the ComEd right-of-way and within the CNRR right-of-way existing easement and appropriated $3,625,000 and $1,000,000 respectively, of ¼% Sales Tax for Transportation and Public Safety funds; and
WHEREAS, this County Board, at its meeting of November 20, 2012, approved Agreement #2 with ComEd for the relocation of distribution facilities located within the ComEd right-of-way, south of Rollins between Illinois Route 83 and Mallard Creek Road, for the Rollins Road at Illinois Route 83/CNRR intersection/grade separation improvement and appropriated $1,800,000 of ¼% Sales Tax for Transportation and Public Safety funds; and
WHEREAS, ComEd has completed updated design work to include the installation of a new 36" casing running 340' west under Illinois Route 83 and the CNRR as well as the installation of 920' of 12" duct, 350' of 6" duct and 900' of 2" duct, relocation of 16 poles, and associated wiring and equipment with the new estimated cost for the relocation of the distribution facilities being $2,995,000; and
WHEREAS, ComEd and Lake County are desirous of amending Agreement #2 to provide for the additional work associated with the relocation of the distribution facilities, setting forth the terms and obligations to each agency, a draft copy of which is attached hereto; and
WHEREAS, a supplemental appropriation of $1,500,000 of ¼% Sales Tax for Transportation and Public Safety funds is needed.
NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that the County Engineer of Lake County is authorized and directed to execute an amendment to Agreement #2 pertaining to the terms and conditions of the above-named utility relocation.
BE IT FURTHER RESOLVED that there is appropriated a supplemental $1,500,000 of ¼% Sales Tax for Transportation and Public Safety funds for this utility relocation, and is designated as Section 08-00080-56-BR.
