Joint resolution authorizing the execution of an agreement between Lake County and the City of North Chicago providing the terms and conditions by which the City shall relocate a portion of the Robert McClory Bike Path in North Chicago in exchange for Lake County transferring ownership of a portion of the North Shore right-of-way to the City of North Chicago.

Staff Summary

                     Robert McClory Bike Path Relocation: City of North Chicago Agreement 

                     The City of North Chicago and Lake County mutually desire to relocate a portion of the bike path to a safer and more desirable location along a similar route in three phases.

                     Phase I of the relocation provides for better security for a chemical business and a better routing of the path adjacent to it.

                     Phase II and Phase III of the relocation fit in with the redevelopment plans of the City.

                     To effectuate Phase I, (between Broadway Avenue and Martin Luther King Jr. Drive) a portion of county ROW needs to be transferred to the city, by Quit Claim Deed.

                     This resolution authorizes the execution of an agreement with the City of North Chicago for this relocation.

                     Conceptual approval for this land transfer was given by the Public Works and Transportation Committee at its March 4, 2009 meeting.

 

Body

R E S O L U T I O N

 

                     WHEREAS, Lake County owns portions of the former Chicago Milwaukee and North Shore right-of-way (County Highway 75) (North Shore ROW); and

 

                     WHEREAS, Lake County owns and maintains the bike path known as the Robert McClory Bike Path on said North Shore ROW in the City of North Chicago; and

 

                     WHEREAS, Lake County and the City of North Chicago desire to have a portion of the Robert McClory Bike Path relocated as depicted in Exhibit A, A1, A2 and A3 of the draft agreement attached hereto; and

 

                     WHEREAS, the county maintains a portion of the Robert McClory Bike Path running along the area of Commonwealth Avenue in the City of North Chicago between Martin Luther King Jr. Drive and Broadway Avenue by agreement with the city; and

 

                     WHEREAS, the City of North Chicago and the Lake County Division of Transportation have previously entered into a Letter of Intent, dated March 24, 2009, stating a mutual desire to transfer a portion of the North Shore ROW owned by the county to the city in exchange the city causing said Robert McClory Bike Path to be relocated and reconstructed between the Martin Luther King Jr. Drive and Broadway  to an improved location as depicted in Exhibit A of the draft agreement attached hereto and labeled as “Phase I relocated bike path”; and

 

                     WHEREAS, the City of North Chicago and Lake County are desirous of entering into an agreement providing the terms and conditions by which the City of North Chicago will cause said bike path to be relocated and reconstructed between said streets and Lake County shall transfer its interest in a portion of said North Shore ROW between said streets to the City of North Chicago, a draft copy of the agreement attached hereto; and

 

                     WHEREAS, said draft agreement contains the terms and conditions by which the City of North Chicago may relocate and reconstruct other portions of the Robert McClory Bike Path as depicted in Exhibit A2 and A3, labeled as Phase II and Phase III relocated bike path; and

 

                     NOW THEREFOR BE IT RESOLVED, that the County Engineer is to finalize the agreement with the City of North Chicago and prepare or have prepared the land transfer documents.

 

                     BE IT FURTHER RESOLVED, that the Lake County Board hereby approves the transfer of the subject property of the North Shore ROW to the city by Quick Claim Deed to be signed by the Chair of the County Board.  

                             

                     BE IT FURTHER RESOLVED, that the Chair of the County Board, the County Clerk, and the County Engineer of Lake County are authorized and are hereby directed to enter into the finalized  agreement with the City of North Chicago stating the terms and conditions by which the City of North Chicago will cause to be relocated a portion of the Robert McClory Bike Path between Martin Luther King Jr. Drive and Broadway Avenue in exchange for Lake County  transferring ownership of a portion of the North Shore ROW to the City of North Chicago; said agreement also containing the terms and conditions for the relocation and reconstruction of other portions of the Robert McClory Bike Path in North Chicago.  The County Engineer shall transmit, in writing, the final agreement to be executed by the Chair of the Lake County Board and the County Clerk.
