Ordinance proposing the establishment of a Lake County Special Service Area Number 15 to provide for a sanitary sewerage system to serve the Forest Haven Subdivision.
 
Staff Summary
·      A petition was filed in April of 2008 by the residents of the Forest Haven Subdivision requesting the County Board establish a Special Service Area (SSA) to finance the construction of a new sanitary sewer system that will replace the existing septic systems within the subdivision.
·      There are a total of 116 lots within the subdivision and preliminary sanitary sewer system alternatives and associated costs have been presented to the petitioners.
·      Sanitary sewer service to this subdivision is contingent upon the construction of downstream sewer improvements that are part of an Agreed Order entered on October 1, 2008 in the Millennium Maintenance Management, Inc. v. County of Lake case that contemplates construction of sewer improvements by the County.
·      An Ordinance proposing the establishment of a Special Service Area Number 15 has been prepared and sets the public hearing date for Wednesday, December 10, 2008 at the St. Basil Serbian Orthodox Church in Mettawa.
·      The ordinance also authorizes the establishment of a hearing panel comprised of five (5) hearing officers to conduct the public hearing on behalf of the County Board.
·      Following the adjournment of the public hearing there will be a sixty (60) day objection period during which time, if at least 51 percent of the electors residing within the SSA and at least 51 percent of the owners of record of property within the SSA sign a petition objecting to the formation of the SSA, then the SSA may not be established for at least two (2) years.
·      This ordinance also establishes the maximum amount of any bonds for the Forest Haven SSA to be $3,800,000; which would be payable over not more than a 30-year period and would result in approximately a $2,640 annual property tax payment for each property owner.
·      Adoption of this ordinance shall in no way represent a determination that the Forest Haven SSA should be established within the SSA Territory, but shall merely initiate the required steps to permit consideration of whether establishing such Forest Haven SSA is desirable and appropriate.
