Resolution on Zoning Board of Appeals application 001162-2026 for a rezoning of two parcels from the Residential-1 zoning district to the Residential-6 zoning district.

 

Staff Summary

                     The Housing Opportunity Development Corporation, contract purchaser, on behalf of the Lake County Housing Authority, record owner, has petitioned to rezone two parcels totaling 2.56-acres from the Residential-1 (R-1) zoning district to the Residential-6 (R-6) zoning district.

                     The subject property is located at 22843 and 22795 W. North Lakewood Ln., Lake Zurich, Illinois; PINs 1416100056 and 1416100057. The applicant proposes to construct a 24-unit residential apartment building “Midlothian Manor”.

                     The rezoning petition is partnered with Zoning Board of Appeals (ZBA) application No. 001163-2026 for a Conditional Use Permit (CUP) for a Planned Unit Development (PUD) and Preliminary Development Plan.

                     At the close of the Lake County Zoning Board of Appeals hearing held on May 28, 2026, the ZBA unanimously recommended approval of the rezoning request in conjunction with a recommendation with conditions of the accompanying ZBA CUP-PUD Preliminary Development Plan.

RESOLUTION

 

WHEREAS, a public hearing has been held by the Lake County Zoning Board of Appeals (ZBA) on May 28, 2026, pursuant to the Statutes of the State of Illinois on the petition of the Housing Opportunity Development Corporation, contract purchaser, on behalf of the Lake County Housing Authority, record owner, who seeks a rezoning of two parcels (PINs 1416100056 and 1416100057) totaling 2.56 acres from the Residential-1 (R-1) zoning district to the Residential-6 (R-6) zoning district for the following real estate, legally described in ZBA application No. 001162-2026 Exhibit A - Legal Description; and

 

WHEREAS, your Planning, Building and Development Department duly considered the aforesaid petition and recommends that it be approved; and

 

WHEREAS, your Zoning Board of Appeals, after a review of testimony and evidence presented at the May 28, 2026, public hearing on the aforesaid petition and subsequent approval of a resolution of findings of fact supporting its recommendation at its June 25, 2026, ZBA meeting, has submitted its report thereon to the Planning, Building, Zoning and Environment Committee of the Lake County Board, which recommends by a vote of 7 - 0 that the petition be approved; and

 

WHEREAS, your Planning, Building, Zoning and Environment Committee duly considered the petition and reports aforedescribed and recommends the petition be granted.

 

NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that PINs 1416100056 and 1416100057 (a.k.a. 22843 and 22795 W. North Lakewood Ln., Lake Zurich, Illinois) be rezoned from the Residential-1 (R-1) zoning district to the Residential-6 (R-6) zoning district; and

 

BE IT FURTHER RESOLVED, that the Secretary of said Zoning Board of Appeals be instructed to notify the Petitioners as to the action taken by the Board.
