Joint resolution authorizing the execution of a revised "Agreement of Understanding," with the State of Illinois, in accordance with 605 ILCS 5/5-402 of the Illinois Compiled Statutes, providing for the expedited processing of the County's construction and maintenance projects administered through the Illinois Department of Transportation (IDOT) under Motor Fuel Tax policies and procedures.

R E S O L U T I O N
WHEREAS, Lake County, by and through its Division of Transportation, presently constructs and maintains highways with funds administered under Motor Fuel Tax policies and procedures through IDOT; and
WHEREAS, 605 ILCS 5/5-402 of the Illinois Compiled Statutes provides for IDOT to approve Agreements of Understanding with counties to insure that the funds are expended in a manner as prescribed by law, and rules and regulations deemed necessary by IDOT when IDOT finds that the County Engineer's office is adequately organized, staffed, equipped and financed to discharge the duties of IDOT; and
WHEREAS, this Lake County Board, at its meeting of January 14, 1992, authorized the execution of such an Agreement of Understanding between the State of Illinois and Lake County. Such agreement was executed March 3, 1992; and
WHEREAS, this Lake County Board, at its meeting of November 12, 2002, authorized revisions to the Agreement of Understanding between the State of Illinois and Lake County. Such agreement was executed January 22, 2003; and
WHEREAS, the State of Illinois and Lake County have reviewed said Agreement of Understanding and are desirous of making certain revisions to said Agreement of Understanding; and
WHEREAS, it is in the best interest of Lake County to enter into a revised Agreement of Understanding with the State of Illinois providing for the expedited processing of said road fund projects administered under Motor Fuel Tax policies and procedures and recognizing the new County Engineer.
NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that the County Board Chair, the County Clerk, and the County Engineer of Lake County are authorized, and they are directed to execute on behalf of Lake County, a revised Agreement of Understanding with the State of Illinois providing for the expedited expenditures of the County's construction and maintenance projects administered through the Illinois Department of Transportation (IDOT) under Motor Fuel Tax policies and procedures and recognizing the new County Engineer, a draft is attached hereto.
BE IT FURTHER RESOLVED that the County Engineer shall transmit, in writing, the final agreement to be executed by the County Board Chair and the County Clerk.
BE IT FURTHER RESOLVED that copies of this agreement, when executed in its final form, be submitted to the Illinois Department of Transportation for their approval and final processing.
