Staff Summary

·      The 1976 retail sewer agreement and 1979 retail water agreement between the County and the Village of Third Lake have expired.

·      A new agreement has been prepared that combines retail sanitary sewer and water supply services into one 20 year agreement.

·      The agreement has been ratified and approved by the Village of Third Lake's Board.

·      This resolution authorizes the execution of an agreement for retail sanitary sewer and retail water supply services with the Village of Third Lake.

Body

R E S O L U T I O N

WHEREAS, the County of Lake (County) owns and operates the water and sewer systems that serve the Village of Third Lake (Village) within the Northeast Central Lake Facilities Planning Area; and

WHEREAS, the County and the Village entered into a 1976 Retail Sewer Agreement and a 1979 Retail Water Agreement, both of which have expired; and

WHEREAS, the County and the Village wish to enter into a new agreement in order to update, extend and modify their respective public sanitary sewer collection/transport and public water supply obligations in Lake County; and

WHEREAS, the County and the Village desire to enter into this agreement to permit the Village to obtain sanitary sewer for the Village Retail Sewer Service Area and water supply services for the Village Retail Water Service Area from the County's sewer and water systems serving the Northeast Central Lake Facilities Planning Area; and

WHEREAS, the appropriate Agreement for Retail Sanitary Sewer and Retail Water Supply has been prepared, and ratified by the Village of Third Lake; and

WHEREAS, execution of said Agreement must be authorized by Resolution of this County Board.

NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the Chair of the County Board and the Clerk of said County be and they are hereby authorized and directed to execute the attached Agreement for Retail Sanitary Sewer and Retail Water Supply Services to the Village of Third Lake.
