RESOLUTION
WHEREAS, Roberts Road, County Highway 35, is a designated route on the County highway system; and
WHEREAS, in order to increase non-motorized connectivity and provide benefit to the safety and welfare of the traveling public, Lake County and the Village of Tower Lakes (Village) desire to install a shared-use path crossing of Roberts Road from North Lake Shore Drive to South Circle Drive; and
WHEREAS, in 2002, the County, through its Division of Transportation, signed a Letter of Concurrence for a joint project with the Village of Tower Lakes to construct a bike path along Roberts Road from North Lake Shore Drive to East Lake Shore Drive (hereinafter 2002 AGREEMENT); and
WHEREAS, the County constructed this existing shared-use path as a county facility in accordance with the 2002 AGREEMENT; and
WHEREAS, the Village desires to construct a shared-use path crossing to provide safe access to the existing path and agrees to assume ownership and maintenance responsibility over the existing path along Roberts Road from North Lake Shore Drive to East Lake Shore Drive; and
WHEREAS, in accordance with the 2002 AGREEMENT, the County agrees to reimburse the Village for construction of the shared-use path crossing; and
WHEREAS, Lake County and the Village are desirous of entering into an agreement stating the terms and conditions for construction and maintenance of these improvements, a draft copy attached hereto; and
WHEREAS, an appropriation of funds is required.
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that the County Board Chair, the County Clerk, and the County Engineer of Lake County are authorized and hereby directed to execute an agreement, and any amendments, with the Village of Tower Lakes stating the terms and conditions for the construction and maintenance of a shared-use path crossing of Roberts Road from North Lake Shore Drive to South Circle Drive and maintenance of the existing shared-use path along Roberts Road from North Lake Shore Drive to East Lake Shore Drive; and
BE IT FURTHER RESOLVED, that the County Engineer shall transmit, in writing, the final agreement, and any subsequent amendments, to be executed by the County Board Chair and the County Clerk; and
BE IT FURTHER RESOLVED, that $54,000 of ¼% Sales Tax for Transportation funds are hereby appropriated for the construction of the shared-use path crossing, and designated as Section 24-00086-10-BT.
