Staff Summary

•                     The Supreme Court Public Defender Fund 251 was established in 2023 to provide funding for use by public defenders for public defender services and related expenses, including but not limited to salaries, contractual services, commodities, equipment and training.

•                     The State Public Defender Act (55 ILCS 5/3-4014 (b) states “funding from the State Public Defender Fund to a county under this Section shall augment rather than replace county-level public defense budgets.”

•                     This resolution requests that $31,015 of unspent funds from the Fiscal Year 2025 Supreme Court Public Defender Fund 251 that are currently in fund balance be emergency appropriated for use in Fiscal Year 2026 for immediate use.

•                     For the State Fiscal Year 2027 (July 1, 2026, through June 30, 2027), the Supreme Court Public Defender Fund allocation is approximately $107,006 for the 19^th Judicial Circuit and it is requested that the funds be emergency appropriated into Fund 251 upon receipt and any unspent funds carried over to the County’s Fiscal Year 2027 budget.

RESOLUTION

 

WHEREAS, the State Public Defender Act (55 ILCS 5/3-4014 (b) states “funding from the State Public Defender Fund to a county under this Section shall augment rather than replace county-level public defense budgets”; and

WHEREAS, this resolution requests that $31,015 of unspent funds from the Fiscal Year 2025 Supreme Court Public Defender Fund 251 that are currently in fund balance be emergency appropriated for use in Fiscal Year 2026 for immediate use; and

WHEREAS, for the State Fiscal Year 2027 (July 1, 2026, through June 30, 2027), the Supreme Court Public Defender Fund allocation is approximately $107,006 for the 19^th Judicial Circuit and it is requested that the funds be emergency appropriated into Fund 251 upon receipt and any unspent funds carried over to the County’s Fiscal Year 2027 budget.

NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that an emergency appropriation in the amount of $138,021 to the Supreme Court Public Defender Fund, Fund 251, for labor and various operational costs as identified on the attachment in the Office of the Public Defender is hereby authorized.
