Staff Summary
·      The Dimucci Family has submitted an application to rezone 108.79 acres of land
located on the southeast corner of Route 12 and Old McHenry Road from the Estate
(E) District to the General Commercial (GC) District and a Conditional Use Permit (CUP)for a Planned Unit Development (PUD) and PUD Preliminary Plan approval for a nonresidential development consisting of a 53 acres surrounded by over 50 acres of open space.
·      Due to concerns raised during the ZBA public hearing process about the size and scale of the project and the project's impact on the surrounding area, discussions were initiated between the County and the Villages of Hawthorn Woods and North Barrington. These discussions resulted in a Letter of Intent prepared between representatives of the County and the villages that included an agreement on development conditions, mutual obligations between the County and villages, and a draft framework for a local land resource management plan and intergovernmental agreement to be executed by the County and the two villages.
·      The resulting local land resource management plan and intergovernmental agreement provide conditions for the development of the property, guarantees for public sewer and water service, and provisions for retail sales tax sharing between the County and two villages, among other necessary terms, rights and responsibilities by which the development project will be administered.

WHEREAS, RK123, LLC, RDDT Limited Partnership, General Partner DFFT-1, LLC, Robert and Constance Dimucci Trustees ("The Dimucci Family") has submitted an application to rezone 108.79 acres of land located on the southeast corner of Route 12 and Old McHenry Road ("The Dimucci Property") from the Estate (E) District to the General Commercial (GC) Zoning District and a Conditional Use Permit (CUP)for a Planned Unit Development (PUD) and PUD Preliminary Plan approval for a nonresidential development consisting of a 53 acres surrounded by the remainder of the property in permanent open space; and
 
WHEREAS, during the public hearing process for the Dimucci Family's application, the County of Lake and the villages of North Barrington and Hawthorn Woods have identified mutual concerns over the project's size and scope, compatibility with the surrounding area, and the potential impact of the development on the villages of Hawthorn Woods and North Barrington; and
 
WHEREAS, a Letter of Intent has been prepared between representatives of the villages and the County of Lake establishing conditions for the development of the property, guarantees for public sewer and water service, and provisions for retail sales tax sharing between the County and two villages, among other necessary terms, rights and responsibilities by which the development project will be administered; and
 
WHEREAS, concurrent with the County Board's approval of the Dimucci Family application, the County and the villages of North Barrington and Hawthorn Woods wish to enter into an Intergovernmental agreement to effectuate such terms, rights and responsibilities by which the project will be administered; and
 
WHEREAS, execution of an Intergovernmental Agreement must be authorized by Resolution of this County Board; and
 
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois that the Chair of the County Board and the Clerk of said County be and they are hereby authorized and directed to execute the Intergovernmental Agreement Relating to the terms, rights and responsibilities adhering to the development of the Dimucci Property in substantially the form attached and subject to the Villages' approval of this Intergovernmental Agreement.
