Joint resolution authorizing the execution of an agreement with the State of Illinois/Illinois Department of Transportation (IDOT) for the jurisdictional transfer of Cedar Lake Road, from the north edge of pavement of Illinois Route 120 to approximately 5,276 lineal feet to the north and east to the west edge of pavement of North Cedar Lake Road, from the State of Illinois to Lake County and designated as Section 08-00065-02-RS.

 

Staff Summary

                     Cedar Lake Road Jurisdictional Transfer from IDOT to Lake County.

                     Cedar Lake Road, from the north edge of pavement of Illinois Route 120 to approximately 5,276 lineal feet to the north and east to the west edge of pavement of North Cedar Lake Road, will be transferred from the State of Illinois to Lake County.

                     The State of Illinois will provide $300,000 to the County for assuming jurisdiction and maintenance of this section of Cedar Lake Road.

R E S O L U T I O N

 

WHEREAS, Cedar Lake Road, north of Illinois Route 120, is an unmarked route on the State highway system; and                     

 

WHEREAS, the free flow of traffic along Cedar Lake Road is beneficial for the safety and welfare of the State of Illinois and Lake County; and

 

WHEREAS, Lake County is willing to assume the jurisdiction and maintenance of Cedar Lake Road; and

 

WHEREAS, the State of Illinois and Lake County are desirous of entering into an agreement for the jurisdictional transfer of Cedar Lake Road from the north edge of pavement of Illinois Route 120 to approximately 5,276 lineal feet to the north and east to the west edge of pavement of North Cedar Lake Road from the State of Illinois to Lake County, a draft copy attached hereto; and

 

WHEREAS, the State of Illinois will reimburse Lake County $300,000 for assuming jurisdiction and maintenance of Cedar Lake Road.

 

NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that Cedar Lake Road from the north edge of pavement of Illinois Route 120 to approximately 5,276 lineal feet to the north and east to the west edge of pavement of North Cedar Lake Road, in its entirety, will be added to the County Highway System of Lake County as an extension of County Highway 28 in accordance with the applicable provisions of the Illinois Highway Code and as approved by the Illinois Department of Transportation.

 

BE IT FURTHER RESOLVED that the County Clerk and the County Board Chair be authorized and they are hereby directed to execute this agreement and any subsequent amendments. The County Engineer shall transmit in writing the final Agreement for Jurisdictional Transfer to be executed by the County Board Chair and the County Clerk.

 

BE IT FURTHER RESOLVED that a copy of this Agreement for Jurisdictional Transfer, when executed in its final form, be submitted to IDOT for their approval and final processing.

 

BE IT FURTHER RESOLVED that the County Clerk, County Board Chair and the County Engineer of Lake County are authorized and are hereby directed to prepare and transmit whatever information IDOT determines is necessary to document the addition to the County Highway System of Cedar Lake Road from Illinois Route 120 to approximately 5,276 lineal feet to the north and east to the west edge of pavement of North Cedar Lake Road in accordance with the provisions of 605 ILCS 5/5-106.
