Staff Summary
·      Rollins Road at Illinois Route 83: Village of Round Lake Beach Agreement.
·      The intersection of Rollins Road, at Illinois Route 83, will be improved along with construction of a grade separation of the Canadian National Railroad (CN RR) to provide increased traffic capacities (Rollins Road Gateway Improvement).
·      In order to provide for this improvement, the County requires right-of-way, permanent easement and temporary easements from the Village of Round Lake Beach for the roadway improvements, as well as the relocation of Village sanitary sewer and watermain facilities and the construction of detention ponds, drainage improvements, sidewalk, multi-use path and landscaping.
·      The Village will reimburse the County for its share of the sidewalk and multi-use path and for the construction and relocation of the Village's sanitary sewer and watermain facilities, estimated at $1,362,897.
·      The Village will maintain the portion of the sidewalk, multi-use path and landscaping along Rollins Road, Hainesville Road, and Illinios Route 83, as identified in the agreement.
·      This resolution authorizes the transfer of land, and the execution of an intergovernmental agreement with the Village of Round Lake Beach.

ORDINANCE FINDING IT NECESSARY OR CONVENIENT FOR LAKE COUNTY TO ACQUIRE AND USE REAL ESTATE OWNED BY THE VILLAGE OF ROUND LAKE BEACH IN CONNECTION WITH THE ROLLINS ROAD AT ILLINOIS ROUTE 83 IMPROVEMENT
WHEREAS, Rollins Road, County Highway 31, is a designated route on the County highway system; and
 
WHEREAS, the Village of Round Lake Beach and Lake County believe it would be beneficial for the safety and welfare of the motoring public if Rollins Road, at its intersection Illinois Route 83, could be improved along with construction of a grade separation of the CN RR to provide increased traffic capacities (Rollins Road Gateway Improvement); and
 
WHEREAS, this improvement requires right-of-way, permanent easement, and temporary easements from the Village of Round Lake Beach for the roadway improvements as well as the relocation of sanitary sewer and watermain facilities and the construction of detention ponds, drainage improvements, sidewalk, multi-use path and landscaping along Rollins Road, Hainesville Road, and Illinois Route 83; and
 
WHEREAS, the Village of Round Lake Beach will reimburse the County for its share of the sidewalk, multi-use path, sanitary sewer and watermain facilities, estimated at $1,362,897; and
 
WHEREAS, pursuant to Section 10 of Article 7 of the Illinois Constitution of 1970, units of local government, such as the Village of Round Lake Beach and the County, may contract or otherwise associate among themselves in any manner not prohibited by law or ordinance; and
 
WHEREAS, in accordance with the Local Government Property Transfer Act, 50 ILCS 605/0.01, et seq., it is necessary or convenient for the County to use, occupy, or improve the real estate as depicted and described in Exhibit A and B, attached hereto, held by the Village of Round Lake Beach in the making of a public improvement or for a public purpose; and
WHEREAS, in accordance with the Local Government Property Transfer Act, 50 ILCS 605/0.01, et seq., the Village may transfer right-of-way, permanent easements, temporary easements and temporary use areas in its property to the County upon such terms as may be agreed upon by the corporate authorities of the County and the Village and subject to the provisions of such Act.
WHEREAS, the Village will maintain the portion of the sidewalk, multi-use path and landscaping located along Rollins Road, Hainesville Road, and Illiniois Route 83; and
 
WHEREAS, Lake County and the Village of Round Lake Beach are desirous of entering into an agreement stating the terms and conditions for dedication of right-of-way, granting of a permanent easement and temporary easements, construction and maintenance of sidewalk, multi-use paths, and landscaping; and the relocation of Village sanitary sewer and watermain facilities located within the limits of the County's improvement, a draft copy of which is attached hereto; and
NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that the County Board Chair, the County Clerk, and the County Engineer of Lake County, Illinois, are authorized, and are hereby directed to enter into an agreement between Lake County and the Village of Round Lake Beach stating the terms and conditions for dedication of right-of-way, granting of a permanent easement and temporary easements; construction and maintenance of sidewalk, multi-use paths, and landscaping; and the relocation of Village sanitary sewer and watermain facilities located within the limits of the County's improvement, and designated as Section 08-00080-56-BR.
 
BE IT FURTHER RESOLVED that the County Engineer shall transmit, in writing, the final agreement to be executed by the County Board Chair and the County Clerk.
 
BE IT FURTHER RESOLVED that the Lake County Board hereby adopts the ordinance incorporated herein requesting the conveyance of land parcels for right-of-way, permanent easement and temporary easements from the Village of Round Lake Beach to Lake County.
 
O R D I N A N C E
 
Section 1: Recitals: The recitals set forth above are incorporated as part of this Ordinance by this reference.
Section 2: Declaration of Necessity. The County Board hereby finds and declares that it is necessary, or convenient, for the County to use, occupy, or improve the real estate as depicted and described in Exhibit A and B, attached hereto, held by the Village of Round Lake Beach in the making of a public improvement or for a public purpose.
Section 3: Acceptance of Conveyance of the Village of Round Lake Beach Parcels. The County Engineer is hereby authorized to execute whatever documents are necessary to accept and effectuate the conveyance of the above-described real estate from the Village of Round Lake Beach to Lake County in accordance with this Ordinance. The County Engineer shall prepare, or have prepared, said documents of conveyance.
Section 4: This Ordinance shall be in full force and effect from, and after, its passage and adoption by the County Board.
