Resolution authorizing an intergovernmental agreement between Lake County and the City of Waukegan regarding Lake County’s Belvidere Road Campus.

 

Staff Summary

                     Located within the corporate limits of the City of Waukegan (the “City”), the County owns property located in the northeast quadrant of Illinois Route 120/Belvidere Road and Keller Avenue, commonly known as the Belvidere Medical Campus.

                     On October 27, 2011, the City of Waukegan’s Historic Preservation Commission, in response to an application to landmark the Campus, and despite the objection of the County, approved the Campus as eligible for landmark designation.

                     In recognition of both the County’s objection to the process, and the City of Waukegan’s interest in historic preservation, the City and the County have agreed to an intergovernmental agreement that preserves the County’s rights as property owner and provides certain recognition of the historic nature of the Belvidere Medical Campus.

                     The agreement includes a provision that would give the City a right of first refusal but specific language for this provision has yet to be formulated.

                     This resolution authorizes the agreement and also provides County Administration and the State’s Attorney’s Office the authority to finalize the specific language.

 

Body

WHEREAS, the County is the owner of certain real property located in the northeast quadrant of Illinois Route 120/Belvidere Road and Keller Avenue, which is comprised of various  structures on an approximately 18-acre site (the “Campus”); and,

WHEREAS, the Campus is located within the corporate limits of the City of Waukegan (the “City”); and,

WHEREAS, on December 17, 2001, the City adopted a Historic Preservation Ordinance, Ordinance No. 01-O-144, (the “Ordinance”), which ordinance may be amended from time to time; and,

WHEREAS, this Ordinance created the Historic Preservation Commission (the “Commission”) which investigates and makes recommendations to the City Council regarding properties and structures that may have historic, community, or architectural significance; and,

WHEREAS, On October 27, 2011, the City of Waukegan’s Historic Preservation Commission, in response to an application to landmark the Campus, and despite the objection of the County, approved the Campus as eligible for landmark designation; and,

WHEREAS, In recognition of both the County’s objection to the process, and the City of Waukegan’s interest in historic preservation, the City and the County have agreed to an intergovernmental agreement that preserves the County’s rights as property owner and provides certain recognition of the historic nature of the Belvidere Medical Campus; and,

WHEREAS, the Parties have the authority to enter into this Agreement pursuant to the Illinois Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq.;and,

WHEREAS, The agreement includes a provision that would give the City a right of first refusal but specific language for this provision has yet to be formulated.

NOW, THEREFORE, be it resolved that the County Administrator and the SAO are authorized to finalize language within the IGA, especially as it relates to the right of first refusal; and,

BE IT FURTHER RESOLVED, by this County Board of Lake County, Illinois, that the Chairman of the County Board be hereby authorized and directed to execute the intergovernmental agreement between City of Waukegan and Lake County, Illinois in substantially the attached form, with such final revisions as may be necessary.
