Joint resolution authorizing a contract modification with Clark Construction Group, LLC of Chicago, Illinois, for Construction Manager at Risk Services with a Guaranteed Maximum Price (GMP) on the Lake County Courthouse Expansion Project for the core and shell work as identified herein in the amount of $36,094,172.
Staff Summary
· The contract awarded to Clark Construction in April 2013 contemplates contract modifications for future work as a Guaranteed Maximum Price (GMP) on each distinct phase of construction for the Lake County Courthouse Expansion Project.
· Clark Construction was awarded the first GMP in June 2014 as part of contract modification #1 for the first phase of work referred to as the ComEd enabling work, which is currently underway.
· A second GMP was awarded to Clark Construction in September 2014 for the second phase of construction referred to as the site enabling work in the amount of $6,351,925, which increased the total contract amount from $843,469 to $7,195,394.
· Proposed contract modification #3, the core and shell GMP, includes 10 primary bid packages for detention equipment, architectural precast concrete, glazing/glass, waterproofing, concrete, steel, exterior metal panels, elevators/escalators, masonry and construction hoists.
· Upon execution of contract modification #3, the contract for Clark Construction Group, LLC will include the following components:

RESOLUTION
WHEREAS, on April 9, 2013, the Lake County Board authorized a contract for Construction Manager at Risk Services with a Guaranteed Maximum Price for the Lake County Courthouse Expansion Project including the first phase of services for pre-construction services in the amount of $125,000; and
WHEREAS, based on the success of the pre-construction services, Lake County intends to amend this contract to include a Guaranteed Maximum Price for each distinct phase of construction relating to the Lake County Courthouse Expansion Project; and
WHEREAS, on June 10, 2014, the Lake County Board authorized contract modification #1 for Clark Construction which included a Guaranteed Maximum Price for the first phase of construction in the amount of $626,028 and an increase in pre-construction services in the amount of $92,441; and
WHEREAS, on September 9, 2014, the Lake County Board authorized contract modification #2 for Clark Construction which included a Guaranteed Maximum Price for the second phase of construction in the amount $6,351,925; and
WHEREAS, Clark Construction has submitted a Guaranteed Maximum Price for the core and shell work in the amount $36,094,172; and
WHEREAS, it is in the best interest of the County to move forward with this work as the next phase of the Lake County Courthouse Expansion Project.
NOW, THEREFORE, BE IT RESOLVED, by this County Board of Lake County, Illinois, that Purchasing Agent is authorized to enter into a contract modification #3 with Clark Construction Group LLC of Chicago, Illinois in the amount of $36,094,172 with an emergency appropriation to account # 101-1103920-82020-000-000-000-11309.
