Joint resolution authorizing an agreement with the Commuter Rail Division of the Regional Transportation Authority (Metra), Chicago, Illinois, providing the terms and conditions by which said Metra will grant an easement necessary for the Winchester Road improvement, and designated as Section 10-00151-22-CH.

· This improvement will include adding left turn lanes east bound at the west County access road and west bound into Butler Lake Park, and a barrier median at the Metra tracks.

· This resolution authorizes the execution of an agreement for the acquisition of the necessary easement from Metra.
· The appropriation for these funds is included in the Winchester Road improvement construction appropriation.

R E S O L U T I O N
WHEREAS, Winchester Road, County Highway 69, is a designated route on the County highway system; and
WHEREAS, Winchester Road is in need of left turn lanes, east bound into the west County access road and west bound into Butler Lake Park, and a barrier median at the Metra tracks; and
WHEREAS, this improvement will also require acquisition of an easement from Metra at the cost to prepare of $1,500; and
WHEREAS, appropriation for these funds is included in the Winchester Road improvement construction appropriation; and
WHEREAS, said improvement will widen the existing railroad grade crossing of Winchester Road at the railroad tracks of the Metra railroad, and
WHEREAS, Metra, Chicago, Illinois, is the owner of the property situated within the proposed new easement for the Winchester Road improvement; and
WHEREAS, Lake County, by and through its Division of Transportation, has caused to be prepared preliminary plans and easement plats, said plats identifying easement needs and depicted in Exhibits A contained within the draft agreement attached hereto; and
WHEREAS, Lake County and Metra are desirous of entering into an agreement stating the current terms and conditions by which Metra will grant said easement to Lake County for the Winchester Road improvement, a draft copy of which is attached hereto.
NOW, THEREFORE BE IT RESOLVED, that the County Board Chair, the County Clerk, and the County Engineer of Lake County, Illinois, are authorized and they are hereby directed to execute an agreement and any subsequent amendments, between Lake County and Metra, Chicago, Illinois, stating the terms and conditions by which Metra, Chicago, Illinois, will grant an easement to Lake County for the Winchester Road improvement in consideration of the sum of $1,500.
BE IT FURTHER RESOLVED that the County Engineer shall transmit, in writing, the final agreement and any amendments to be executed by the County Board Chair and the County Clerk.
BE IT FURTHER RESOLVED that the County Board Chair and County Engineer be authorized and they are hereby directed to sign whatever documents are necessary to effectuate said easement.
