Joint resolution authorizing the execution of an intergovernmental agreement among Kane County, Will County and Lake County regarding the advance use of Federal Surface Transportation Program funds allocated by the Illinois Department of Transportation to the counties.

• Surface Transportation Program-Counties (STP-C); SFY 2009 Advance Funding: Intergovernmental Agreement among Kane County, Will County and Lake County.
• Federal STP-C funds, allocated yearly by IDOT, are programmed by the counties of Kane, McHenry, Will and Lake and the counties need to accumulate an IDOT STP-C program balance to construct projects.
• Lake and Will counties have balances with IDOT of approximately $3 million each, while Kane County has a federally eligible project ready for the April letting. (Stearns Road).
• It is in best interests of all 3 counties to spend down the accumulated STP-C balances prior to the expiration of the current Federal Transportation Act (SAFE TEA-LU).
• The agreement provides for SFY 2009 STP-C advance funding for use by Kane County for its Stearns Road project.
• In return, Kane County’s future yearly IDOT STP-C allocations will be reallocated, over 5-years, to Lake and Will counties for their future projects.
• In the event that the next federal transportation act does not contain an equivalent county programmed STP-C program, then the Kane County pay back to Lake and Will counties will be by Kane County local funds.

WHEREAS, Kane County, Will County McHenry County, and Lake County each receive an annual sub-allocation of STP-C funds from the Illinois Department of Transportation (IDOT); and
WHEREAS, Kane County, Will County, McHenry County, and Lake County are desirous to have IDOT obligate through authorization by the Federal Highway Administration their respective STP-C funds prior to the end of the federal fiscal year 2009 to avoid any rescission of STP-C funds; and
WHEREAS, Kane County, Will County, McHenry County, and Lake County have reviewed the status of all proposed projects contained in the STP-C funds program; and
WHEREAS, it has been determined that Kane County’s, Stearns Road project will be ready for a contract letting prior to the end of federal fiscal Year 2009; and
WHEREAS, Will County and Lake County have unobligated balances of STP-C funds totaling $6,291,940; and
WHEREAS, said Kane County Stearns Road project is eligible for the use of the unobligated balance of STP-C funds; and
WHEREAS, Will County and Lake County support and approve the use of Advance STP-C funds in the amount heretofore stipulated for said Kane County project; and
WHEREAS, Kane County, Will County and Lake County are desirous of entering into an agreement for the repayment of said Advance STP-C funds to Lake and Will counties, a draft copy of which is attached hereto.
NOW, THEREFORE BE IT RESOLVED, by this County Board of Lake County, Illinois, that the Chair of the County Board, the County Clerk, and the County Engineer of Lake County are hereby authorized and directed to execute an agreement among Kane County, Will County and Lake County providing the terms and conditions for the use of said Advance STP-C funds by Kane County and the repayment to Will County and Lake County of said funds. The County Engineer shall transmit in writing the final agreement to be executed by the Chair of the County Board and the County Clerk.
