R E S O L U T I O N
WHEREAS, Midlothian Road (County Highway 48) is a designated route on the county highway system; and
WHEREAS, Midlothian Road will be extended northerly from the existing fairground entrance to Moorehead Circle; and
WHEREAS, said extension improvement will cross the existing railroad grade crossing of Harris Rd at the railroad tracks of the Wisconsin Central Ltd. (Canadian National RR), and
WHEREAS, Wisconsin Central Ltd., Homewood, Illinois, is the owner of property situated within the proposed new right-of-way of Midlothian Road; and
WHEREAS, Lake County by and through its Division of Transportation has caused to be prepared preliminary plans and right-of-way plats, said plats identifying right-of-way needs and depicted in Exhibits A & B contained within the draft agreement attached hereto; and
WHEREAS, the free flow of traffic across said grade crossing for the extension of Midlothian Road is beneficial to the safety and welfare of the county as a whole and to the Wisconsin Central Ltd., and
WHEREAS, Lake County and Wisconsin Central Ltd., Homewood, Illinois are desirous of entering into an agreement stating the current terms and conditions by which Wisconsin Central Ltd., Homewood, Illinois will grant said easements to Lake County for the extension of Midlothian Road, a draft copy of which is attached hereto.
NOW, THEREFORE BE IT RESOLVED, that the Chair of the County Board, the County Clerk, and the County Engineer of Lake County, Illinois, are authorized and they are hereby directed to execute an agreement and any subsequent amendments, between Lake County and Wisconsin Central Ltd., Homewood, Illinois, stating the terms and conditions by which Wisconsin Central Ltd., Homewood, Illinois will grant easements to Lake County for the said extension of Midlothian Road in consideration of the sum of $15,000. The County Engineer shall transmit in writing the final agreement and any amendments to be executed by the Chair of the County Board and the County Clerk.
BE IT FURTHER RESOLVED that the Chair of the County Board and County Engineer be authorized and they are hereby directed to sign whatever documents are necessary to effectuate said easements.
BE IT FURTHER RESOLVED that there is hereby appropriated $20,000 of ¼% Sales Tax for Transportation and Public Safety fund and designated as Section 09-00244-03-RR.
