· The County has awarded a contract to widen and reconstruct Delany Road, from Sunset Avenue northerly to York House Road.
· On August 11, 2009, the Lake County Board approved an agreement with the City of Waukegan for their portion of the cost of the improvement, but which agreement did not include the costs of the watermain relocation to be undertaken by the City independently.
· The City has had difficulty in acquiring the necessary easements for the watermain relocation and funding the work.
· Amendment No. 1 is to ensure that construction of the County's Delany Road improvement can move forward in a way that benefits both parties.
· The County and the City will swap portions of roads that better meet their roadway system functions: the County receives Lewis Avenue (Sunset Avenue to York House Road) and the City receives the dead end portion of York House Road, Delany Road to Canadian Pacific Rail Road (CP RR).
· The County will save funds from the programmed resurfacing of York House Road (CP RR tracks to Delany Road), while the City will save the amount of the watermain costs.
· The watermain work will be added as Change Order No. 3 to the County contract in the amount of approximately $1M, and this resolution resets the change order base so future change orders can be processed as originally required.

R E S O L U T I O N
WHEREAS, Delany Road, County Highway 22, is a designated route on the County highway system; and
WHEREAS, in order to provide for the free flow of traffic and ensure the safety of the motoring public, Lake County has let a contract for the improvement of Delany Road, from Sunset Avenue to York House Road, by widening, resurfacing, and reconstruction, said improvement designated as Section 00-00093-17-WR; and
WHEREAS, this Lake County Board, at its meeting of August 11, 2009, approved an agreement with the City of Waukegan providing the terms and conditions for the City's portion of the cost of the improvement, but which did not include the costs of the watermain relocation to be undertaken by the City independently; and
WHEREAS, Lake County and the City of Waukegan are desirous of entering into amendment No.1 to the agreement for the above-said improvement, a draft copy attached hereto, to address the timeliness of the watermain relocation by making the work a part of the County's contract as Change Order No. 3 in the approximate amount of $1 million; and
WHEREAS, the County and the City have agreed it is desirable to swap jurisdictions of portions of roads that better meet their roadway system functions: the County to receive Lewis Ave (Sunset Ave to York House Road) and the City to receive the so called "dead end" portion of York House Road (Delany Road to CP RR), both jurisdictional changes to require the approval of the Illinois Department of Transportation: and
WHEREAS, the said jurisdictional transfer of roadways will enable the County to eliminate the County's future programmed resurfacing cost on the said "dead end" portion of York House Road (Delany Road to CP RR).
NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that the County Board Chair, the County Clerk, and the County Engineer of Lake County be authorized and they are hereby directed to execute amendment No. 1 to the agreement with the City of Waukegan to accommodate the inclusion of the City of Waukegan's watermain relocation costs as Change Order No. 3 as part of Section 00-00093-17-WR and to provide by separate agreements the roadway jurisdictional transfers as follows: the County to receive Lewis Ave (Sunset Ave to York House Road) and the City to receive the so called "dead end" portion of York House Road (Delany Road to CP RR).
BE IT FURTHER RESOLVED that this resolution being presented to the County Board for approval, the Public Works and Transportation Committee and the Finance and Administrative Committee, hereby have approved change order No. 3 to Section 00-00093-17-WR.
BE IT FURTHER RESOLVED that the County Engineer, for the processing of approval of subsequent change orders on the contract for Section 00-00093-17-WR, is hereby authorized and directed to treat the awarded base construction cost for the Delany Road improvement for Section 00-00093-17-WR as $11,078,048.28 calculated as follows: the awarded amount of $10,056,082.94, plus Change Order No. 1 of $17,130.60, plus Change Order No. 2 of $4,113.50 and plus Change Oder No. 3 at $1,000,721.24.
BE IT FURTHER RESOLVED that the County Engineer shall transmit, in writing, the final agreement, to be executed by the County Board Chair and the County Clerk.
