Resolution to enact an ordinance to restrict the use of the future bike path along Peterson Road (County Highway 20) and Fremont Center Road (County Highway 62) and name said bike path as the “Fort Hill Trail”.

                     The county proposes to place a bike trail along Peterson Road from Midlothian Road to Fremont Center Road extended and south along Fremont Center Road.

                     The bike trail will connect with a bike trail to be constructed by the Lake County Forest Preserve in its Ray Lake Preserve.

                     The county and the Forest Preserve desire to name both trails as the “Fort Hill Trail”.

                     In order to regulate the use of this bike trail for the safety and convenience of the public, a Use Restriction Ordinance is necessary.

                     This resolution adopts a Use Restriction Ordinance and designates the county portion of the bike path name as the “Fort Hill Trail”.

 

Body

 

WHEREAS, the COUNTY OF LAKE, ILLINOIS, acting by and through its Chair and County Board, hereinafter referred to as the COUNTY, is desirous of designating the FORT HILL TRAIL, hereinafter referred to as the TRAIL, as a COUNTY bicycle path along Peterson Road (County Highway 20) from Midlothian Road (County Highway 48) to Fremont Center Road extended (County Highway 62), then south along said Fremont Center Road extended to its intersection with the LAKE COUNTY FOREST PRESERVE DISTRICT’s segment of the said TRAIL where it terminates at the Fremont Center Road right-of-way; and

 

WHEREAS, the COUNTY needs to regulate the use of the TRAIL for the safety and convenience of the public; and

 

WHEREAS, the Illinois Compiled Statutes, as amended, 605 ILCS 30/2, provides the authority to the COUNTY to regulate the use of said TRAIL; and

 

WHEREAS, the Illinois Compiled Statutes, as amended, 625 ILCS 5/11-208, provides the authority to the COUNTY to regulate the operation of bicycles; and

 

WHEREAS, the Illinois Compiled Statutes, as amended, 55ILCS 5/5-1067, provides the authority to the COUNTY to name said TRAIL,

 

NOW, THEREFORE BE IT ENACTED BY THE COUNTY BOARD OF LAKE COUNTY, ILLINOIS

 

 

 

 

 

 

                     FORT HILL TRAIL USE ORDINANCE

 

SECTION 1: INTRODUCTION

 

The TRAIL, located within the rights-of-way of Peterson Road and Fremont Center Road as heretofore described is hereby officially named the FORT HILL TRAIL.  The general location and alignment of said TRAIL is depicted on APPENDIX A of THIS ORDINANCE.

 

SECTION 2: APPLICABILITY

 

This Ordinance applies to the TRAIL.

 

SECTION 3:                     RESTRICTED USES

 

Said TRAIL is restricted to the following uses:

 

a)                     bicycles

b)                     pedestrians

c)                     all vehicles and equipment of the Lake County

                     Division of Transportation or its authorized agents

d)                     police and emergency vehicles

e)                     vehicles and equipment of government, or private

                     utility companies, for the maintenance of their utilities along the

                     said TRAIL

 

All other motorized and non-motorized vehicles and means of conveyances are prohibited from using said TRAIL including but not limited to the following:

 

a)                     motor vehicles

b)                     motorcycles

c)                     motor bikes

d)                     mini-bikes

e)                     mopeds

f)                     go-carts

g)                     dirt bikes

h)                     all terrain vehicles

i)                     equine

j)                     equine drawn vehicles

k)                     snowmobiles

 

SECTION 4.                     SIGNS

 

This Ordinance shall not be enforceable until signs giving notice that motorized vehicles and equines are not allowed on said TRAIL have been posted by the COUNTY ENGINEER at entrances to the TRAIL from public streets crossing the TRAIL.

 

 

 

SECTION 5.                     ENFORCEMENT

 

Any full-time or part-time peace officer, employed by either the COUNTY, or by a municipality which is a party to an intergovernmental agreement with the COUNTY which grants such arrest authority, is hereby authorized to arrest any person violating any of the provisions of this Ordinance.

 

SECTION 6.                     PENALTIES

 

The penalty upon conviction for violating any provision of this Ordinance shall be a fine of not less than $50.00 nor more than $500.00.

 

SECTION 7.                     SEVERABILITY

 

Should any portion of this Ordinance be declared by a court of competent jurisdiction to be invalid the same shall not affect the validity of this Ordinance as a whole or any part thereof other than the part so declared invalid.

 

SECTION 8.                     EFFECTIVE DATE

 

This Ordinance takes effect on the first of the month immediately after adoption by the COUNTY.

 

SECTION 9.                     AMENDMENTS

 

This Ordinance may from time to time be amended as seen fit by the COUNTY.

 

SECTION 10.  REPEALER

 

Any Ordinance or resolution in conflict with this Ordinance is repealed insofar as it conflicts.
