R E S O L U T I O N
 
WHEREAS, this Lake County Board, at its meeting of March 13, 2012, approved a contract award to USIC Locating Services, Inc., Indianapolis, Indiana, in the amount of $50,880; and
 
WHEREAS, the USIC bid was later found to be non-responsive due to an exception limiting their liability; and
 
WHEREAS, pursuant to authority granted by this Lake County Board, the Purchasing Agent heretofore called for sealed re-bids, by publication, for the storm sewer locates and ticket screening services required for the Lake County Division of Transportation to comply with the "The Illinois Underground Utility Facilities Damage Prevention Act" (i.e., JULIE) and designated as Section 12-00000-06-GM; and
 
WHEREAS, pursuant to said publication, and calling for said re-bids, sealed bids were received and opened on April 16, 2012, at 2:00 p.m. at the Lake County Government Office in Waukegan, Illinois; a tabulation of said bids being as follows:

WHEREAS, the Public Works and Transportation Committee, the County Engineer and the Purchasing Agent have examined each bid, and it appears that the lowest responsible bidder is USIC Locating Services, Inc., Indianapolis, Indiana, with a contract amount of $76,020, based on estimated quantities and unit prices; and
 
WHEREAS, this Lake County Board, by prior resolution at its meeting of January 17, 2012, appropriated $80,000 of Matching Tax funds for these services.
 
NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that a contract be awarded to said USIC Locating Services, Inc., Indianapolis, Indiana, with a contract amount of $76,020, based on estimated quantities and unit prices, and that the Purchasing Agent be authorized, and is hereby directed, to enter into a contract with said low bidder to provide for the storm sewer locates and ticket screening services required by the Lake County Division of Transportation to comply with the "The Illinois Underground Utility Facilities Damage Prevention Act" and designated as Section 12-00000-06-GM.
 
BE IT FURTHER RESOLVED that in as much as such estimated quantities are the best approximation that can be determined at this time, these quantities may be added to, deducted from, or modified from in the final determination of the contract cost in accordance with Chapter 605 of the Illinois Compiled Statutes, Act 5, Section 5-205.2 without further Board action, providing the final cost chargeable to the funds appropriated does not exceed the appropriation.
