R E S O L U T I O N
WHEREAS, pursuant to authority granted by this Lake County Board and the Newport Township Road District Highway Commissioner, the County Engineer heretofore called for sealed bids, by publication, for bituminous pavement removal, patching, and resurfacing of Dilleys Road and Mill Creek Road, in the Newport Township Road District, and designated as Section 13-11109-02-GM; and
WHEREAS, pursuant to said publication and calling for said bids, sealed bids were received and opened on March 19, 2013, at 10:00 A.M. at the Lake County Division of Transportation in Libertyville, Illinois, a tabulation of said bids being as follows:

WHEREAS, this County Board, at its meeting of April 9, 2013, awarded a contract to Curran Contracting Company, Crystal Lake, Illinois, in the amount of $169,705.92, as the lowest responsible bidder based on estimated quantities and unit prices; and
WHEREAS, on August 27, 2013, the County Engineer received a memo from the Newport Township Highway commissioner, Rodger L. Edmonds, requesting to rescind the contract with Curran Contracting Company, Crystal Lake, Illinois, due to lack of township funding, a copy of the memo is attached hereto; and
WHEREAS, the County Engineer is in agreement with the request from the Newport Township Highway Commissioner, with approval from the County Board.
NOW, THEREFORE BE IT RESOLVED by this Lake County Board, that the contract with Curran Contracting Company, Crystal Lake, Illinois, in the amount of $169,705.92 for bituminous pavement removal, patching, and resurfacing of Dilleys Road and Mill Creek Road, in the Newport Township Road District be rescinded in its entirety.
BE IT FURTHER RESOLVED that the County Engineer shall notify the Newport Township Highway Commissioner, in writing, along with a certified copy of this resolution, that the contract is rescinded.
